Dear Mr. Hines:
It has been brought to our attention that a possible violation of the Springfield
Comprehensive Zoning Code exists on your property at 6559 Main Street, Springfield,
Oregon. The violation has to do with a possible commercial business in a resi-
dential zone. During a recent conyersation, you informed me that you store trucks
at your residential property, which are picked up in the morning by people who work
for you and parked in the evening. You also stated that no 'actual work is performed
at your residence with the exception of receiving business phone calls.
After discussing the nature of this situation for compliance with the Zoning Code
with Mr. Joe Leahy, Assistant City Attorney, it is his opinion that the storing of
more than one vehicle to be used by persons other than yourself is in conflict
with the residential zoning of the property. While, one vehicle used by .....a mem-
ber of the family residing on the premises..... is not in conflict with the defini-
tion of a Home Occupation as described in the Springfield Zoning Code, the storage
of more than one truck used for a business would constitute a repair garage which
the Zoning Code describes as .....a building used for the storage, parking, care or
repair of motor vehicles, or where such vehicles are kept for remuneration, hire, or
sale." Please refer to the attached copies of the Springfield Comprehensive Zoning
Code. A Home Occupation is allowed in a residential zone, but a repair garage is a
permitted use only in a commercially zoned area.
'You will have thirty (30) days from the date of this letter to bring the use of your
property into compliance with the Springfield Comprehensive Zoning Code. Your anti-
cipated cooperation is appreciated.
