Reooest: An application for a six-lot Medium Density Residential (MDR) subdivision was
submitted to the Springfield Plarilling Division on May 24, 2007 for, property -located ~t 232
South 42nd Street in Springfield. The application pr<?poses to subdivide ap' existing 1.13 acre
parcel into six MDR lots, '
Status of the Annlication: Incomplete - Potential Denial. The applicant was provided a list
of items required for completeness after two pre-submittal meetings held' on February 10, 200'6
and December 5; 2006. The tentative subdivision plan application was submitted on May' 24,
2007, The City's Development Review Committee reviewed the tentative plan on June 12,20'07
and identified flawed elements that - once corrected - could have a significant effect on the
proposed site design, easement configuration and parcel 'layout. The elements cannot be
reasonably conditioned, and therefore a decision rendered on this application would result in a
denial.
To be considered complete, the applicant must prepare and re-submit the following information:
I, The tentative plan sheets are not consistent with each other, and none reflect the current
property line configuration. ,More specifically, the dedication of a variab1e~width street
right-of-way along the South 42nd Street property frontage (Bargain and Sale Deed
#2006-042859,Lane County Deeds & Records) is not shown on the Site Assessment Plan
or accurately depicted on any other accompanying plans. The submitted tentative plan
. shows a proposed I O-foot wide right-or-way dedication,
2., The applicant has shown walls inside the public ,utility easements abutting the South 4151
Place and South 42nd Street frontages. The City previously requested that the walls be
moved outside the PUEs and that the applicant provide a detail for the proposed wall
(December 5, 2006 pre-submittal meeting). This information has not been addressed.
Moving the walls further into the site may require adjustment to the bioswales - which in
turn could affect the proposed easements and building envelopes for Lots I and 4.
3. The Professional Engineer's stamp on the Site Assessment Plan has expired and must be
renewed.
4, The, location and dimensions of proposed _private easements are not consistent on each
plan sheet, and the easements do not entirely contain the bioswales (particularlY'the
bioswales within proposed Lots I and 4). '

5. The proposed building 'envelopes are not consistent on each plan sheet, and some do not
appear to meet the setback criteria of the, Springfield Development Code, Article 16
(notable example: the proposed building footprint on Lot 5, Sheet 2 of 4).
6. The utilitY information on the various plan sheets is inconsistent, 'and does not match
what is actually in the ground. Among other things, the sanitary sewer line running
north-south within South 42nd Street is an 8-inch line, not a 6-irich lirie. The Grading and
Paving Plan also depicts a 12-inch waterline intersecting a 18-inch storm sewer line in
South 42nd Street. '
7, The stormwater rimofffrom proposed Lots 1,2, and 6 is proposed to be directed,into a
private stoTInwater pipe in the joinhuse driveway area. However, the submitted Grading
and Paving Plait does not show the proposed private system intersecting with the public
stormwater system. The applicant shall have the plans revised as necessary to clearly
show how the proposed private stormwater systein meets Plumbing Code requirements
and connects to the public system.
8. The, tentative subdivision plan and easement plan state that no cut or till is proposed.
However, the grading and paving plan states that 90 CY of cut and 1080 CY of fill is
proposed. Again, all plan sheets should contain consistent information,
TIlls is the minimum information required for a decision to be rendered on this application. The
Springfield Development Code (SDC) requires,that submittal requirenients of SDC 3,050 be
fully met prior to application acceptance for review, A decision based on the incomplete
information submitted would result in a denial. The state,-mandated 120-day.processing time
for this land use decision was initiated May 24, 2007 when the applicant submitted the
application form and fees. To ensure this decision period does not lapse while the City considers
your revised submittal information, a Waiver and Request for Extension form is attached for
your consideration. The Request for Extension would extend the period for renderi~g a decision
on this matter by an additional 30 days. The applicant must submit a written response by June
19,2007 that confirms receipt of this letter and the applicant's intentions regarding the provision
of the additional information. All materials required for this application to be c'onsidered
complete must be submitted by June 26,2007, including the attached Request for Extension.

If the, applicant is silent regarding this letter, the Ci,ty will deem the application complete for the
purpose of processing a decision~' In this case" the City will begin processing the application on
June 27, 2007 and issue a denial of the application. Alternatively, the applicant may withdraw
the application in which case a new subdivision pre-submittal would be required. Because the
subdivision submittal was already circulated for staff and' external review, only a partial refund
of the subdivision application fees would,be considered. '
