It looks like most of our comments were addressed in the revised copy. Here are a few additional comments we have: 1. Sheet 2,6 and 7. The labels added for "Point A" and "Point B" included reference to Certificate on Sheet 7 of 7. This should be "Sheet 8 of 8". 2. Sheet 6. The distance of "794.04" along the easterly Parcel line should be eliminated as it does not apply to this map, 3, Sheet 4, The labels for the Corps of Engineer easements seem to be reversed as to what they were in phase II. (Vol. 353, Page 232 and Vol. 353, Page 224.) On this map it appears that they are pointing to the same area, and on Phase II it appears that one of the easements (Vol. 353, Page 224) is labeling the area adjacent to the High Water line. ,4. In the Declaration include a statement th~t owner acknowledges easements of record as shown on plat. Peggy Hunter Lane County Surveyor's Office 682-3633 Next, the additional comments we have at the City; First, there were some edits to the Declaration of Reciprocal Easements that were discussed at the Partition Pre-Submittal meeting on December S, 2008 that were requested by the City Surveyor that have not been addressed. . The document is structured as such that the easements discussed are "private". This is clarified further by the section 6.1. But in the 6th Ii'ne und~r section 1.2 it says that public utility facilities are included. Public utilities are also mentioned in line 14 and in ,line 24 of this section. There can be no public utility facilities included if you are defining the easement as per the section 6.1 "Not a Public Dedication". ' . In section 1.3, we cannot allow a structural encroachment easement. The wording can remain in ,line 3 about an "easementfor any emergency exit from a building (not to exceed '6 feet)" but the following language cannot ;, " have an easement to cover th~t encroachment. When an encroachment is discovered, either an encroachment by accident or intentional, it is req~ired that the property line is adjusted by a "Property Line Adjustment" survey per ORS 92.010,8, b. We suggest ~hat language is included in this section stating it is a requirement of the owner of the encroaching parcel to perform a "Property Line Adjustment" survey when a structural encroachment is discovered. . . In Exhibit A it says "Lot 8 SubdiVision of RiverBend, Phase #2" and it needs to be changed to ".. River8end, Phase 11'1 . If there are any questions about these comments regardingthe Declaration of Reciprocal Easements, please contact Dennis Ernst as he was the one attending the Pre-Submittal meeting and had the discussion as to what changes the City required, or myself, Chris Moorhead. Plat comment: . On Sheet 1, under "Note:", more clarification needs to be on numbers 3 and 4 as to why they are noted. Something as simple as ",....affects this plat." is acceptable, butjust the reference to the document is not . t . enough. 1 Date i'{<':lceived: Planner: AL J k /c .2oot 2;;.-~ In regards to the plat, when you feel you'have addressed these edits stated above (the one City comment and the 3 County comments), you are welcome to submit mylars to us. PLEASEKEEP IN MIND, the City needs to do a field check of the plat monuments before we will sign off on the plat. We ask that you submit another copy of the Declaration of Reciprocal Easeme'nts .for the City's review before we sign and accept the plat as.well.
