One request I have from the City Surveyor's office is that the letter should be in a recordable "agreement" format that can be cited on the plat document. Because the encroachment will need to be shown on the plat, a separate recorded document can be referenced instead.of lengthy text. This will also avoid the requirement for a Deed Restriction or Right-of-Way Use Agreement that are more cumbersome. Danny Denning may be able to provide some guidance on this, and you can confirm the "agreement" requirements with the City Su!"'eyor's office. Please let me know if you have any other questions. However, a change of tenancy would not be supported because the house is not connected to City utilities and it would prolong the encroacbmenl within public right-of-way.
