SubJect: Lot 8 Partition - Remaining House in Right-of-way Philip: Staff have determined that the residential dwelling still remaining on Lot 8 and partially encroaching within undeveloped. public right-of-way can remain for a reasonable period of time. To facilitate this arrangement and to ensure the Lot 8 partition plat can be finalized in a timely manner, the City requests the followin&:' . I) A letter from PeaceHealth stating the tirneframe for occupancy of the dwelling, the anticipated date of removal, and that demolition and removal of the structure and appurtenances is entirely the responsibility of PeaceHealth. 2) A written estimate, from a professional contractor for demolition and removal of the structure, foundation, and related improvements that encroach within or otherwise encumber the public right-of-way including, but not limited to, decommissioning and removal of any hazardous materials (eg. asbestos, lead-based paint), underground utilities, septic system, fences, private well, etc. 3) An escrow deposit in the amount of 110% of the written estimate for demolition and removal of the structure and appurtenances. The City may be amenable to extending the timeframe,for the current tenant's occupancy by mutual agreement with PeaceHealth. However, achange,ofienancy would not be supported because the house is not connected to City utilities and it would prolong the encroachment within public right-of-way.
