The standards of the Springfield Development Code (SDC) applicable to each criterion of approval are listed herein and are satisfied by the submitted plans and notes (see Appendix A) unless specifically noted in this decision with findings and conditions necessary for compliance. The final plot plan, as well as the installation of public and private improvements, must conform to the approved tentative plan or as conditioned herein. This is a ministerial decision made according to city code and state statutes. This decision is final and may not be appealed. Please read this document in its entirety. USES AUTHORIZED BY THIS DECISION The proposed use of this site for elementary schools is permitted subject to the special locational and/or siting standards of 4.7-195 in accordance with SDC 3.2-170. No other uses are authorized by this decision. REVIEW PROCESS This application has been reviewed under the procedures listed in SDC 5.1-125, Type I Applications, and SDC 5.15-100, Minimum Development Standards. This application was submitted on December 20, 2007, accepted as complete on January 29, 2008, and this decision is issued 15 days after complete submittal of the application. SITE INFORMATION The subject property is a 10 acre (434,232 square feet), rectangular-shaped lot at the corner of 23'" Street and Yolanda Avenue and is located inside the City limits. The property is relatively flat, and currently, the property contains an elementary school with associated parking, playing fields, and playground. The property is zoned Public Land and Open Space and is designated Low Density Residential, and land immediately surrounding the property to the north, west, and east is zoned Low Density Residential while land to the south is likewise zoned Public Land and Open Space. SDC STANDARDS APPLICABLE TO MDS APPROVAL SDC 5.1-125 and 5.15-120 state that that an application shall be approved or approved with conditions upon determination that the criteria listed in SDC 5.15-120 A. through H. and any applicable Refinement Plan, Base Zone, Overlay District, or Specific Development Standards have been satisfied and that if conditions cannot be attached to satisfy the approval criteria, the application shall be denied. Criterion 1 IOverlav Districts and SDecific DeveloDment Standards\ Finding: SDC 4.7-195 states that for schools in residential districts, light shall be directed away from adjoining less intensive uses in conformance with SDC 4.5-100. Condition 1: Prior to occupancy, proposed on-site lighting for the boiler room shall conform with the on-site lighting standards outlined in SDC 4.5-100. Finding: As conditioned above, this application meets the requirements of SDC 4.5-100. Finding: The subject property falls within both the zero to one year and the one to two year Time of Travel Zones (TOTZs) for the Pierce wellhead. The applicant has submitted neither a Drinking Water Protection (DWP) Overlay District Development application nor a letter requesting exemption from the DWP regulations of SDC 3.3-200. Condition 2: Prior to final plot plan approval, the applicant shall submit and receive approval for either a Drinking Water Protection (DWP) Overlay District Development application or a letter requesting exemption from the DWP regulations of SDC 3.3-200. Case No. DRC2007 -00082 2017 Finding: As conditioned above, this application meets the requirements of SDC 3.3-200. Finding: The northwest corner of the subject property is within the 100-year flood zone, and the majority of the remainder of the site is within the 500-year flood zone. However, the proposed boiler room lies outside both the 100-year and 500-year flood zone as depicted on the submitted plans. Therefore, the subject project does not require approval of a Floodplain Overlay District Development application. Conclusion: This application satisfies Criterion 1 (SDC 4.7-195, 3.3-200, & 3.3-400) as conditioned herein. Criterion 21SDC 5.15-120 A.' A 5-foot wide landscaped planter strip, including street trees, with approved irrigation or approved drought-resistant plants as specified in SDC 4.2-140 and 4.'4-100, shall be installed between the sidewalk and parking areas or buildings. Finding: The applicant has not proposed a five-foot wide landscaped planter strip between the sidewalk and parking areas or buildings. However, the applicant has proposed planting a five-foot wide landscaped planter strip with evergreen shrubs around the west, south, and east facades of the boiler room building. The applicant has not indicated whether the planter strip will be planted with drought- resistant plants or if an irrigation system is proposed. Finding: SDC 4.7-195 A.6. states that all plants, used for landscaped buffering for schools in residential districts shall reach a height of at least 36 inches within one year of planting. In addition, SDC 4.4-105 E. states that the minimum planting acceptable per 1,000 square feet of required planting area is two trees, not less than six feet in' height that are at least two inches in caliper and ten shrubs, five gallons or larger. Condition 3: Prior to occupancy, the applicant shall install a five-foot landscaped planter strip around the west, east, and south facades of the boiler room building that conforms to the landscape planting and buffering standards of SDC 4.7-195 A.6. and 4.4-105 E. Condition 4: Prior to final plot plan approval, 'the applicant shall guarantee the use of native species in the required planter strip or shall provide plans for a permanent underground irrigation system. Finding: As conditioned above, this application meets the requirements of SDC 4.4-100. Conclusion: This application satisfies Criterion 2 (SDC 5.15-120 A.) as conditioned herein. Criterion 31SDC 5.15-120 B.' Trash receptacles and outdoor storage areas shall be screened by a struclure or enclosure' permanently affixed to the ground as specified in SDC 4.4-110. Finding: The existing trash/recycling area on the site does not meet the standards of SDC 4.4-110. Condition 5: Prior to occupancy, the applicant shall screen the trash/recycling area with a structure or enclosure permanently affixed to the ground as specified in SDC 4.4-110. The screening shall be non- metallic and of a subtle color to blend with surrounding vegetation in conformance with SDC 4.4-110. B.3.b. Finding: As conditioned above, this application meets the requirements of SDC 4.4-110. Conclusion: This application satisfies Criterion 3 (SDC 5.15-120 B.) as conditioned herein. Case No. DRC2007 -00082 3017 Criterion 41SDC 5.15-120 C.\ Bicycle parking spaces shall be added to meet the numerical standljjTds for the appropriate use or upgraded 10 meet the standards specified in SDC 4.6-140, 4.6-145, and 4.6-155. Finding: Existing bicycle parking on the site does not meet the standards of SDC 4.6-140 through 4.6- 155. Condition 6: Prior to occupancy, the applicant shall install bicycle parking in conformance with SDC 4.6-140 through 4.6-155. Finding: As conditioned above, this application meets the requirements of SDC 4.6-140 through 4.6- 155. Conclusion: This application satisfies Criterion 4 (SDC 5.15-120 C.) as conditioned herein. Criterion 51SDC 5.15-120 D.I Parking'and circulation areas shall be paved and striped and wheel stops installed as specified in SDC 4.6-100 and 4.6-120. Required paving and olher impervious surfaces on Ihe site shall comply with on- site stormwater management standards as specified in SDC 4.3-110 for required parking, circulation, and storage area impervious surfaces only. Finding: Existing facilities are adequate to meet the requirements of SDC 4.6-100 and 4.6-120. Conclusion: This application satisfies Criterion 5 (SDC 5.15-120 D.). Criterion 6/SDC 5.15-120 E.\ Access to the public right-of-way shall comply with SDC 4.2-120. Finding: Existing facilities are adequate to meet the requirements of SDC 4.2-120. Conclusion: This application satisfies Criterion 6.(SDC 5.15-120 E.). Criterion 7/SDC 5.15-120 F.\ Concrete sidewalks shall be installed where the site abuts a curb and gutter street as specified in SDC 4.2-135. Finding: Existing facilities are adequate to meet the requirements of SDC 4.2-135. Conclusion: This application satisfies Criterion 7 (SDC 5.15-120 F.). Criterion 8 IS DC 5.15-120 G.\ Streetlights shall be installed as specified in SDC 4.2-145. Finding: Existingfacilities.are adequate to meet the requirements of SDC 4.2-145. Conclusion: This application satisfies Criterion 8 (SDC 5.15-120 G.). Criterion 91SDC 5.15-120 H.\ The development shall connect to public utilities as specified in SDC 4.3-105, 4.3-110, 4.3-120, 4.3- 125, and 4.3-130 and comply wilh the Springfield Building Safety Codes, where applicable. Easements may be required as specified in SDC 4.3-140. Finding: Existing facilities are adequate to meeUhe requirements of 4.3-105 through 140. SUMMARY OF CONDITIONS OFAPPROVAL NOTE: This summary of the conditions of approval is provided as a courtesy to the applicant. The tentative plan approved as submitted and conditioned .herein may not be substantively changed prior to the final approval process without approval by the City. . WHAT NEEDS TO BE DONE? 1. Within 30 days of this decision, the applicant must submit a Final Plot Plan demonstrating compliance with the aforementioned conditions of approval and stating the starting date of all required improvements.'.In addition, the applicant must submit the.materials listed ih SDC5,15- _ 125 A. 1. through 4, wnere applicable. 2. Within 45 days of the Director's approval of the Final Plot Plan, the property owner must sign a Development Agreement, prepared by Staff, to ensure that the terms and conditions of this application are binding upon both the applicant and the City. The Development Agreement must be signed prior to issuan'ce of building permits; 3. Within 90 days of this decision, the applicant must construct the required improvements. If this timeline cannot be met, the applicant may submit a written request for a timeline extension as specified in SDC 5.15-1258. NOTE: , The applicant may, at hislher 'own risk, submit construction ,or building plans to other City departments for review prior to approval of the Final Plot Plan. However, all concurrent submittals' are subject to revision for compliance with the Final Plot Plan. A Development Agreement will not Case No, DRC2007-00082 5017 be issued until all plans submitted by the applicant have been revised to comply with the Final Plot Plan. Conflicting plans cause delays. If the 90-day timeline for constructing required improvements is riot met and the applicant has not requested an extension as specified above, the application is considered null and void if the property is occupied and the property owner will be considered in ,violation of the SOC. , If the 90-day timeline for constructing required improvements is not met.and the applicant requests an extension as specified above but does not' meet that timeline either, the Director may. require that the improvements be installed as specified in SDC 5.17-1.50. PERMIT REQUIREMENTS .. All new private water, sewer, and stormwater laterals require plumbing permits from the Community Services Division . All new sewer laterals require permits from the Public Works Department prior to con.nection . Sidewalks, as well as curb cuts and curb cut closures require permits from the Public Works Department . . The construction of buildings and paving of parking lots require permits from the Community Services Division . All grading, filling, and excavating requires an LDAP from the Public Works Department . Signs are regulated by the Springfield Municipal Code Article 9, Chapter 7. The number and placement of signs must be coordinated with the Community Services Division, and the location of a sign on a Plot Plan does not constitute approval from the Community Services Division. APPEALS This Type I decision is exempt from the provIsions of ORS 197.195, 197.763, and 227.,173 and therefore cannot be subject to the appeal provisions of SDC 5.3-100, Appeals. In the event that the applicant disagrees with the application of the development standards in this decision, the applicant may request a Type III Interpretation or.submit a Type II Site' Plan Review application.
