Purpose: Minimum Development Standards (MDS) are intended to support
economic development by minimizing City' review for minor additions,
expansions or changes in use. MDS shall ensure compliance with specific
appearance; transportation safety and efficiency;: arid stormwater. .
management standards specified in the Springfield Development Code (SDC)
and otherwise protect public health, safety and welfare. . .,
Criteria of Approval: In order to grant MDS approval, the Director shall
determine compliance with all applicable standards specified below:
A) A five-foot wide landscaped planter strip, including street
trees, with approved irrigation or approved drought resistant
plants as specified in SDC Sections,4.4-100 and 4.2-140 shall
be installed between the sidewalk and parking areas or .
buildings.
EXCEPTIONS:
1. Where there is an unimproved street, a four foot wide landscaped
planter strip shall be required to be set back one foot from the
property line.

2. Where there is insufficient space for the landscaped strip required
in Subsection A., above due to existing buildings, street width; paved
parking, changes of elevation or location of utilities including catch
basins, the Director may approve:
a. Decorative fencing iocated immediately behind the property
line. The fencing may be wrought iron or masonry and shall be
subject to the fence height standards of the applicable zoning
district and the vision clearance setbacks of Section 4.2-130;
and/or ,
b. Landscaping. equivalent to the amount.required in Subsection
. A" above may be placed at the property corners or other areas
of the property that are visible from the street.
Finding:. Established landscaping exists on the site. However, as the
development requires the relocation of the existing trash enclosure, ,a, ,
landscape plan showing existing and replacement landscaping is necessary.
X Proposal complies when the following condition is met:
Condition 1: Submit a complete landscape plan showing existing
landscaping as w.ell as replacement landscaping.
B) Trash receptacles and outdoor storage areas shall be screened by
a structure or enclosure permanently affixed to the ground as
specified in SDC Section 4.4-100.

Finding: The Springfield Engineering Design Standards and Procedures
(EDSP)3.03.4.A references higher-risk activities that may contribute to water
quality degradation. This section is based on Chapter 4..4.C of the City of
Portland Bureau of Environmental Services' (BES) Storm water Management
Manual, which includes solid waste storage areas, containers, and trash
compa<;:tors.

and ensure that the trash enclosure,is hydraulically isolated.
C) Bicycle parking spaces shall be added to meet the numerical
standards for the appropriate use or upgraded to meet the standards
set in SDC Sections 4.6-140, 4.6145 and 4.6-,155. ,

D) Parking and circulation areas sh'all be paved and striped and
wheel stops installed as specified in SDC Sections 4.6-100 and 4.6-
120. Required paving and other impervious surfaces on the site shall

comply, with on-site stormwater management standards as specified
in SDC Section 4.3-110 for required parking, 'circulation area and
storage area impervious surfaces only.
Finding: The Springfield Engineering Design Standards and Procedures
(EDSP) 3.03.5 requires that one hundred percent (100%) of parking lots and
paved areas be pre-treated for stormwater quality.'
x ' Proposal complies when the following Condition is met:
Condition 3: The existing catch basin shall be retrofitted with a city
approved stormwater filter insert and a maintenance agreement put in place
to provide for the ongoing maintenance of the filters.
E) Access onto the public right-of-way shall comply with SDC Section
4.2-120.
Finding: The existing vehicle access to the site is provided by a 36 foot
driveway entry to Main Street. No revisions are proposed as part ofthis
application. '
Finding: Two pedestrian connections between the Main Street sidewalk
and site are being proposed, one serving the proposed coffee shop and one
to an existing 'ATM structure. The ADA access requires a direct route from the
parking space to the destination. The current location of the trash enclosure
precludes a direct route.
Condition 4: The Final Site Planshall show relocation of the trash
enclosure and pedestrian access leading from the Main Streetsidewalk to the
coffee kiosk constr'Ucted per ADA requirements.
Finding: The Transportation Division requires service lanes to be 70 feet
in length for drive through facilities to accommodate the vehicles generated
by each service window.' The proposed service lane for the drive-up window
on the north side of the structure is only 40' in length and only able to
accommodate two vehicles. Additional vehicles waiting in this line would
block the access aisle creating an unacceptable situation possibly affecting
the Main Street entrance. The service lane on the south side of the structure
is only 20' in length; however it appears that vehicles may be able to be
accommodated without affecting access to on-site parking or drive aisles.
Finding: Directional sign'age 'or striping will be required to be provided
on-site to direct drivers into the appropriate access aisles.
Finding: This portion of Main Street is under the jurisdiction of the
Oregon Department of Transportation (ODOT).ODOT has determined that
the existing approach road permit (05A 22,255) is subject to review. Change

of Use of an Approach and a new application for S,tate Highway approach
may be necessary. '
Condition 5: Final Site plan shall be designed to provide for the
required, 70 foot service lane for the drive~up window on the north side of the
kiosk. Please Lise shading to show the location ,of the service lanes. Please
provide dimensions for the service lanes (width and length).
Condition 6: 'Final Site plan shall show where four vE;!hicles will be
able to be accommodated waiting for the south service window so that
vehicles will not block access to parking or drive aisles.
Condition 7 Final Site Plan shall show all proposed on-site pavement
markings (arrows etc..,).

Condition 8: Final Site plan shall show, the relocation ofthe proposed
pedestrian path adjacent to the service aisle. Staff recommends that the
path extend through the patio area and cros~ t,he service aisle at a
perpendicular angle,

Condition 9: ,Prior to Final Site Plan Clpproval, applicant will obtain
~rom ODOT either a valid Approach Permit or written documentation that the
existing Permit is still valid.
G) Streetlights shall be installed as specified in SDC Section 4.2-135.

H) The development shall connect to public utilities as specified in
Sections 4.3-105, 4.3-110 and 4.3-120 of the SDC and comply with
the Springfield Building Safety Codes, where applicable. Easements
, may be required as specified in Subsection 4.3-140 ',ofthis Code.

Timelines and Conditions of Approval: The property owner and/or
applicant has 30 days from the date of this decision to submit a Final Plot
Plan (the Final Plot Plan must be to scale and indicate the scale on
the plan> demonstrating compliance with the fol.lowing~ondi~ioris of
Approval:

existing Permit is still valid.
In order to complete' the review process, a Development Agreement is
required within 45 days from the date .of this decision to ensure'the terms
and conditions of this application are bindirig upon both the applicant and the
City. This agreement will be prepared by Staff and upon approval of the
Final Plot Plan, must be signed by the property owner prior to issuance of a
building permit and land use approval.
The construction of the required improvements shall begin within 90 days of
the date of this decision. If the established time line cannot be met, the
applicant may submit a written request for a time line extension as'specified
in SDC Section 5.15-125.
The Director may allow a one-time extension of the 90-day start of
construction time line due to situations including but not limited to; required
permits from the City or other agencies, weather conditions and the
unavailability of asphalt or the unavailability of-street trees. If the time
extension is allowed, security shall be provided as specified in SDC Section
5.17-150 of .this Article. The time line extension shall not
exceed 90 days. '

If the established time line is not met and the applicant has not requested an
extension, the Director shall declare the application null and void if the
property is occupied and the property owner shall be considered in violation
of this Code. If the established time line is not met and the applicant has
requested an extension and that time line has not been met, the Director
may require the improvements be installed as specified in SDC Section 5.7-
150.
Permits That May Be Required:
. All new sewer taps will require permits from the Public Works
Department prior to connection.
. Building permits will be required for the construction of the building
and the paving of the parking lot.
. An LDAP permit will be required for all grading, filling and excavating
being done.
. Sign Permit-NOTE: Signs are regulated by the Springfield Municipal
Code Article 9, Chapter7. The number and placement of signs must be
coordinated with the Community Services Division. The location of
signs on a Site Plan does not constitute approval from the Community
Services Division.
Additional Information:
The application, all documents, and evidence relied upon by the applicant,
and the applicable criteria of approval are available for free inspection and
copies are available for a fee at the Development Services Department, 225
Fifth Street, Springfield, Oregon.
Appeals: This Type I decision is exempt from the provIsions of ORS
197.195, 197.763 and 227.173 and therefore cannot be subject to the'
, appeal provisions of SDC Section 5.3-100, Appeals.
