Dear Mr. Hann:
The Child Center, located at 3995 Marcola Road (Assessor's Map 17 02 20 Tax
Lot 700) is a non-conforming use in the M-3 zone in which it ,is located. The
Child Center and the M-3 zoning were both in existence on this property before
the property was annexed to the City of Springfield in January of 1975.
The City of Springfield's Planning, Building, and Fire Marshall's personnel
,are all aware of the Child Center and the City will take no action to close it
out as a non-conforming use~ since it is currently operating within all state and
local requirements for a day care center. We do encourage you to apply for a zone
change to rezone the property to R-l Single Family Residential District with a
conditional use permit, as this action, if approved by the Planning Commission and
City Council, would remove the non-conforming use status and allow the continued
operation of the facility despite any temporary interruption in its operation due
to fire, wind storm, etc. for a period of up to six months. The Center would also
have to cease operation if more than 50 percent of the building was destroyed by a
fire or other natural disaster,' as. ~ong as it remains a non-conforming use.
