Project Description: The applicant, LibertyBank, proposes to develop a new corporate headquarters office building on Lot 3 of the Liberty Professional Center at the northeast corner of International Way and Corporate Way. Refer to the Type II Site Plan Approval application being submitted concurrently for the project. The development of the site includes a new 3 story office building, with a proposed maximum height of the building that exceeds the allowable building height for the Campus Industrial zone,' , .,. ' Project Location: Project site is located at 250 Internationai Way. The property is Lot 3 of the Liberty Professional Center, Tax Map No. 17-03-15-4.0, Tax Lot 300. Zoning for the site is CI- Campus Industrial. Variance Request The applicanlis requesting a variance from the building height st<jndards 'of the Campus Industrial District, SDC Section 3.2-420, that limits building heights to 45 feet. This request is for allowing portions of the building to go up to a maximum of 52 feet in height, not including incidental equipment on the building. A variance in building height of up to 30% of the base allowable height is allowed as noted in SDC Section 5.21-,125(A)(3), and this increase of 7 feet is within the 3.0% range allowed under a Minor Variance req uest. . The primary reasons for requesting this variance are: _ a. To provide a slightly higher floor-to-floor height for the three story building, allowing for better daylight penetration to the interior of the building and for more room to integrate mechanical and electrical systems inside the building. . b. To give greater flexibility in parapet height variation to provide stronger visual interest to the building, in compliance with the Campus Industrial Design Standards, c. To provide more opportunity to allow the building parapets to screen roOftop mechanical equipment._. II /6~ J . A complete application page. A completed and signed application page is submitted herewith. 2..../f the Variance being requested is part of a concurrent application including a site plan, preliminary site plan or tentative plan, those documents may be substituted for the required plot plan. This Minor Variance request is concurrent with a Type II Site Plan Approval application (City Case No. PRE2007.00070). Please refer to the drawing set included with the Site Plan Approval application for site pian, building plan, and building elevation drawings. 3, The application fee. A check for the application, is included with this application and narrative. 4. A Variance may be granted only if the proposal is determined by the Approval Authority to meet al/ of the fol/owing criteria: . a. There are unusual conditions. associated with the property or structure which make it impractical to use the development area for'its intended purpose under the Springfield Development Code. The development standards for the Campus Industrial zone limit building heights to 45 feet. This makes it difficult for development of a 3 story building with appropriate floor to floor heights and height available for appropriate roof design and screening. Development of a 3 story office building allows for better utilization of the available land and helps to limit the amount of associated land needed for this specific deveiopment, allowing land to be available for other uses, b. Granting of the Variance would not be inconsistent with both Metro Plan. Allowing'for a slightly taller building would nofbe inconsistent,with the MetroPlan. Issues such as intended us of the site, connection to transportation systems, open space, and preservation of natural features will still be met with full compliance by the project. . c. Granting of the Variance would not be inconsistent with the Springfield Development Code. Allowing for a slightly taller building ~ould,not be inconsistent.with any section of the Springfield Development Code, other than the building height limitations that this variance is addressing. While there are no solar standards that the project needs to comply with, the land to the north of the subject side is City-owned open space and will not be adversely affected by the additional height of the building. Building height increases in the Campus Industrial district have not yet been formally addre.ssed by the City, but this issue has been raised in the past. In a March 13, 2006 memo from John Tamulonis and Gary Karp to the Springfield Planning Commission, it was noted "AI/owing for infil/ with a few tal/er buildings, perhaps four stories (about 63 feet...) would provide a more efficient use of the relatively few remaining medium-to-Iarge sites,'" , . Other sections of the Springfield Deveiopment Code, such as building design, parking requirements, or landscape requirements will not be affected by this Variance and the overall design will still comply with all sections. In additional, the increase in building height will not create any other inconstancies in the design in reg~rds to the building code or to the emergency access to the site or building. . Granting of the Variance wouid have no significant adverse affects on the public welfare for neighboring properties, and there <ve provisions to mitigate those adverse affects which will be a condition of use. . There will be no' advers~ affect to the public or to adjacent properties by the granting of this Variance. As noted previously, solar standards to not apply to the project and the property to the north is City-owned open space. The additional height requested to the building should minimal if any aff~ct to this property since the primary areas where a height increase is being requested is on the south side of the building so building shadowing increases will be limited. e, The need for the Variance has not arisen solely from a previous Code violation and the hardship is not self-imposed. This Variance request does not arise from self-imposed hardship. The request allows for better flexibility in the final design of the building and will allow for better daylighting internal to the buiiding and better screening of rooftop mechanical equipment on the building from adjacent properties. f, There are no other practical alternatives available that better meet the provisions oUhe Springfield Development Code ahd Metro Plan. This Variance request only addresses building height limits of the Campus Industrial zone and so there are no alternatives available for addressing the needs for the project than this request. , . .
