Re: U of 0 Bookstore (The Duck Store) Building Expansion
Dear Steve:
On behalf of the Duck Store, I would request that you reconsider your decision
that the expansion of the inventory warehouse for the Duck Store necessitates
annexation. Contrary to the Agreement Regarding Annexation put before my
client, the applicant does not "propose to annex the Property" nor does the
applicant "anticipate that it will receive significant benefits from annexation of
the property." To the contrary, annexation will result in significant costs to the
Duck Store and significant benefit to only the City.
There could be little doubt that the proposed expansion of the Glenwood
facility requires a major Site Modification, as it is a "substantial increase in the
size of the building"(SDC 55.17-145.C.2). You have advised me that because
majqr site plan modification is required, "there is an increased need for public
services." We submit that simply because there is a substantial increase in
building size, an increased need for public services does not follow.
The proposed expansion will add additional storage area and involve the
addition of three desks or work stations, so the number of employees on site
will increase from 25 to 28. (As prior to the expansion, seven days a year,
before football games, there will continue to be 46 employees on site.) It is
difficult to see how these changes necessitate an increased need for public
services.

The need for public services must be viewed in the context of the history of
the use of the building. We have plans from Stretch and Sew's 1985
occupancy of the building showing a substantial number of office spaces on
the main level that were later removed by the Duck Store for storage space.
In addition, those plans show a few larger spaces on the upper level that were
used for cubical offices. The Duck Store uses this space as storage now and
will not use this space as offices for additional employees, rather as meeting
areas.
Another prior occupant of this site, Learning Services, also had offices, both
upstail'S'and'dbwhstairs, irrareas the Duck Store uses'for,storagec'L.earning
Services had '55 employees on site on a regular basis,
The Duck Store inventory storage facility, as expanded, will simply have less
need for public services than previous uses of the site and no more need for
public services than the present operation on the site,
There is no doubt that the day will come when this property, along with the
rest of Glenwood, will be part of the City of Eugene. At this point, the
requisite need for public services does not exist and annexation will not
provide the property with better public services but will result in a very
substantial impact on the Duck Store.
