OFl91" iT (503) 126-3153 August 21, 1989 Mrs. Jeannine Brundage 2495 Marcola Road Sprin9field, Oregon 97477 Subject: Home Occupation Permit ~ Dear Mrs. Brundage: Thank you for your application for a Home Occupation Permit. Your permit has been approved with Conditions which appear further in this letter. A Home Occupation is a regulated, non~residential activity occurrin9 within a dwelling unit in a residential district. It is of paramount importance the home occupation be conducted so that the residence does not appear to be a business. A home occupation must not infringe on the nei9hbors ri9hts to enjoy the peaceful occupancy of their homes. The Home Occupation provision is in reco9nition of the needs of many people who are engaged in smallMscale businesses which could not be supported if commercial properties were required, or which, due to the nature of the Home Occupation, cannot be expanded to a full scale business. In the description of your proposal you said that the business and sign have been in place since before the property was incorporated. Lane County regulated the activities of Home Occupations prior to incorporation. Lane County's standards permit a smaller sign than the City's and the County regulates that "Customer and cl ient contact shall be primarily by telephone, mail or in their homes and places of business..." and that "There shall be no commodity sold upon the premises, except that products made or sold may be disposed of by delivery from the premises to the homes or places of business of customers". Because Lane County's Horne Occupation re9ulations would not have permitted a wholesale business at this property, the City cannot consider your use to he pre~existing Non-Conforming. Conditions of "pproval: (Section 3.070(3) "...Conditions r.lay be applied to Development Approval under Type I procedure when such conditions,are required to assure the development complies with this Code". 1. All customer, client contact must occur by nail, telephone or off-site. 2. Deliveries agreed to Road. must be made to your clients at their homes or at a nutually site. A si9n meeting the Conditions of Operation #1 on the agreement may be used if mounted on the wall of the building. 4. Conditions #I~9 of the Home Occupation A9reement. This decision becomes final within 10 days of the date of this letter unless appealed in accordance with Article 15 of the Springfield Developmlent Code.
