HOllE OCCUPATION AGREEIlBNT
THE APPLICANT'S SIGNATURE OF THIS AGREEMENT CERTIFIES ACKNOWLEDGMENT OF THE FOLLOWING
CONDITIONS OF OPERATION:
1. EXCEPT FOR THE ONE NON-ILLUMINATED 1 1/2 SQUARE FOOT WALL SIGN PERMITTED IN
SECTION 16.080(1) OF THE SPRINGFIELD DEVELOPMENT CODE, THERE SHALL BE NO DISPLAY
WHICH YOULD INDICATE FROM THE EXTERIOR THAT THE BUILDING IS USED FOR ANY PURPOSE
OTHER THAN A RESIDENTIAL DWELLING.
2. THERE SHALL BE NO OUTSIDE STORAGE OF MATERIALS.
3. NO MECHANICAL EQUIPMENT SHALL BE PERMITTED EXCEPT THAT WHICH IS COMPATIBLE WITH
RESIDENTIAL PURPOSES.
4. THERE SHALL BE NO OFFENSIVE NOISE, VIBRATION, SMOKE, DUST, ODORS, HEAT OR GLARE
NOTICEABLE AT OR ,BEYOND THE PROPERTY LINE RESULTING FROM THE OPERATION.
5. A MAXIMUM OF 2 YORKERS MAY BE EMPLOYED AT ANY GIVEN TIME BETWEEN THE HOURS OF 7
A.M. AND 8 P.M. IN ADDITION TO FAMILY MEMBERS YHO RESIDE AT THE DWELLING.
6. THE OPERATION SHALL NOT CREATE HAZARDOUS TRAFFIC CONDITIONS OR UNDULY BURDEN
ON-STREET PARKING AREAS.
7. IF THE PROPOSED USE REQUIRES A MODIFICATION TO THE DWELLING OR ACCESSORY
STRUCTURE OF A NATURE THAT IS NOT TYPICALLY FOUND IN RESIDENTIAL DISTRICTS, THE
PROPOSED USE SHALL BE CONSIDERED INAPPROPRIATE AND THEREFORE INELIGIBLE AS A
HOME OCCUPATION.
8. COMMERCIAL AUTO REPAIR, INCLUDING BUT NOT LIMITED TO TUNE-UPS, ALIGNMENTS,
BODY-FENDER YORK, PAINTING AND DETAILING, AND UPHOLSTERING SHALL NOT BE
PERMITTED.
9. NO MERCHANDISE OTHER THAN WHAT IS PRODUCED ON-SITE SHALL:BE SOLD TO THE PUBLIC
FROM THE PREMISES.
IT IS UNDERSTOOD THAT IF NEIGHBORHOOD COMPLAINTS ARE RECEIVED, THE NATURE OF THIS
HOME OCCUPATION YILL BE RE-INVESTIGATED. IF THIS HOME OCCUPATION IS FOUND IN
VIOLATION OF THE SPRINGFIELD DEVELOPMENT CODE, THE USE SHALL BE TERMINATED UPON
NOTIFICATION IN WRITING BY THE PLANNING AND DEVELOPMENT DIRECTOR.
IT IS FURTHER UNDERSTOOD THAT APPROVAL OF THIS APPLICATION DOES NOT EXEMPT THE
APPLICANT FROM THE REQUIREMENTS OF ANY OTHER CITY CODES OR ORDINANCES.

Subject: Home Occupation Permits

Dear Mr. Harlow:
In reviewing your application for a building permit at 2433 Harlow Road I
became aware that you are using this address as a real estate office.
This property is zoned Low Density Residential. Home Occupations are permitted
in Low Density Residential Districts provided you agree to and comply with
conditions listed in Article 16 of the Springfield Development COde.
I have enclosed a Home Occupation Permit application. Please review this form
and the conditions of approval listed on the back. If you think feel your
operation qualifies with the conditions please submit the application along
with the required $25. application fee. If your operation does not/cannot be
mOdified to comply with these conditions your real estate office will need to
be relocated to the appropriate commercial zoning district.
Please pay particular attention to conditions 1, 5, 7 and 9.
I am not sure how your business has been operating from this site. If it
operates like a typical real estate office I anticipate the following items as
being a concern to you.
1.
Condition #1 limits signs in residential districts to one (I) wall sign no
larger than I 1/2 square feet in size.
Condition #5 limits the number of employees who live outside of the home to
two (2). In order for these two employees to be permitted an occupancy
inspection needs to be requested through the Building Safety Division.
There is an application form enclosed to request this inspection.
Condition #7 says that if mOdifications to the dwelling are necessary
which are not typically found in residential structures, the permit will
not be approved.

4. Conaition #9 permits customers to the site only if they are purchasing
(retail) something which is proaucea exclusively on site. This means that
if you have clients visiting the office now, they will not be permittea to
in the future. The only non-resiaent use of this property as part of the
business activity woula be the two employees if approvea by the Builaing
Safety Division.
