Dear Karl,
The purpose of this letter is to answer the question we discussed during the Development
Issues Meeting on February 19. Your question was "Can a commercial use in the CC zone
include a parking lot in the HI zone or.on land with an industrial designation?" Based on
review of the Springfield Development Code, it does not appear a commercial use in the CC
zone can utilize a parking lot in the HI zone.
SDC 2.1-115 states that land may be developed only as the Springfield Development Code
permits. .If a single property contains' multiple zoning districts, each portion of the property
must be developed in conformance with the applicable zone.
The list of uses allowed in the CC zone is contained in SDC 3.2-310. A parking lot is an allowed
use. The list of uses allowed in the HI zone is contained in SDC 3.2-410. A parking lot is not
listed as an ailowed use. .
Further, all uses in the CC zone and the HI zone require site plan approval and compliance
with SDC 5.17-125. Subsection (A) requires the zoning to be consistent with the Metro Plan
diagram, and/ or the applicable Refinement Plan diagram. A site plan cannot be approved on a
property that contains a plan/ zone conflict.
In summary, a commercial use in the CC zone cannot include a parking lot ill the HI zone or on
land with an industrial designation.
