I discussed this briefly after ET today and (there is clear consensus for me to proceed and
process this as a Type II~ Furthermore, lid like to meet IF NECESSARY to .review
application submittal requirements for the amendment as this shouldn't be a big deal, at
all. I know there was some angst about what the original site plan application needed to
have to be complete. Hopefully this is such a simple matter that we can proceed without
delay. In my mind, I'd like tOI~see us ready to issue an approval decision within a month,
or less. Please keep me posted'as this proce~ds. Thanks.

Based on the read from Andy, I think we have to ask ourselves whether to elevate to the PC
now or wait for the lnevitable appeal of a Type II modification.

It has always been my understan~ing that the site plan amendment would be processed as a
Type II major modification. Th4 Discretionary Use approval for the Justice Center
specified that the initial site plan application would go to the PC for information
(done). An "alteration of use":: for B Street was requir'ed prior to incorporating it into
the Justice Center site (also done). I would contend that it- doesn't need to go back to PC
unless appealed. If necessary, once the modified site plan is prepared and submitted we
could present it for information at a PC work session.
