Land Use Request The applicant, Lane Transit District (L TD), with the authority of General Growth Properties, Inc., requests approval of a Tree Felling Pennit Application associated with the relocation of LTD's transit stops from the interior of Gateway Mall to the site's perimeter along the west side of Gateway Street. Included with this relocation will be the removal of the existing transit stop and the construction of a covered walkway and a new L TD Bus/EMX Stop, the reeonfiguration of parking stalls and planting islands in the south east parking lot area, and a new exit drive-intersection at Oakdale and Gateway Streets. The subject site is the Gateway Mall and associated parking and drives. The site currently consists of a large consolidated shopping mall and several detached retail and serviee buildings totaling 718,449 square feet, including off-street L TD transit stops. Customer parking areas are located on all sides of the existing mall, but primarily along the Gateway Street to the east. The mall is located near the center of the property, and the site of the proposed LTD's relocated transit facility is southerly of the middle of the mall, fronting on Gateway Street. The area of modification is 2.21 acres. Impacted interior parking area for landscape area requirements is 1.72 acre (74,892 square feet). There are thirty three (33) existing trees with diameters at breast height (DBH) of 5" and over located within the impact area. The applieant proposes to remove.28 trees and replace them with 77 new trees 2" caliper in size in accordance with SDC 4.4-1 05(E)(l). The size, location, and species of proposed new trees and associated shrub/groundcover plantings are shown on the Landscape Plan, Sheets TP2 and TP 3. In accordance with SDC 4.4-105(F), replacement trees and tree types meet city street tree standards as set forth in the Springfield Engineering Design Standards and Procedures Manual. III. Tile Site and Existing Conditions A. Tax Lots The development site occupies Tax Lots 2109, 2200, 2218, 2219, 2300 and 2307 on Lane County Assessor's Map 17-03-22. The actual modifications area includes Tax Lots 2200 and 2300 on Lane County Assessor's Map 17-03-22. All the subject tax lots are owned by General Growth Properties, Inc. exeept Tax Lot 2307, which is owned by Target Corporation. The total land area encompasses approximately 66.25 aeres. All tree removal proposed is on land owned by General Growth Properties, Ine. B. Location and Site Context The subjeet site is located in the Gateway area of northwestern Springfield and is the subjeet of the Gateway Mall site plan (Jo. No. 88-03-35). The location is bounded by Interstate 5 right- of-way to the west, the Circuit City and Big 5 Sporting Goods stores to the south, Gateway Street to the east and a United States Post Offiee facility to the north. The area encompassing the subject site is designated by the Metro Plan Diagram as Commercial. The Commercial designation is adjacent to Low Density Residential and Satre Associates, P .C. The Gateway Refinement Plan Diagram designates the site as Community CommereiaL The subject site is located in a Community Commercial zone that extends north and southeast over adjacent commercial uses. Zoning to the East across Gateway Street is Medium Density ResidentiaL Zoning to the South (Cireuit City and Big 5 Sporting Goods stores) is Community CommerciaL C. Site Descriotion and Existing Conditions The Gateway Mall includes large and small retail and other commercial uses and associated landscaping and parking in an area of approximately 72.25 acres between Harlow Road, 1-5, the U.S. Post Office facility on Postal Way and Gateway Street. The Flood Insurance Rate Map (FIRM) Number 41039CI133F identifies the site as being outside of the 500-year flood. Soil types on the site are classified in the Lane County Soil Survey as Malabon Silty Clay Loam, Salem Gravelly Silt Loam, Malabon-Urban Land Complex, Courtney Gravelly Silty Clay Loam, and Salem-Urban Land Complex. The Wellhead Protection Area map identifies portions of the site as being located within the 20-year and 99-year time of travel zones for the Sports Way well field. IV, Tree Felling Proposal The applicant seeks Tree Felling Permit Application approval for tree removal and replacement as outlined above and shown on the attached plans. The location, species and size of the trees proposed for removal are shown on the Tree Removal Plan, Sheet TPI. They include: . Thirteen (13) Quercus coccinea and nine (9) Liquidambar styraciflua loeated along Gateway Street . Two (2) Lirodendron tulipifera and (2) Cedrus deodara located in two planting islands in the parking lot, generally to the east and southeast of the restaurant space . One (I) Pyrus ealleryana and one (I) Platanus x acerifolia loeated in the planting island of the current L TD bus station south of the Gateway Mall food court. The removal will be completed by a contractor licensed to do the work using accepted site clearing and tree felling techniques and procedures. On site supervision will be present at the time of removal to ensure that no damage to surrounding properties occurs. Ingress and egress will be taken via Gateway Street and Harlow Road V, Approval Criteria This section addresses the applicable Tree Felling Permit Standards contained in SDC 5.19-125. Applicable approval criteria are outlined in italics below, followed by proposed findings of fact in normal text. Satre Associates, P.C. Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger offalling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposedfelling. The requested tree felling and replacement is not requested due to the condition of the trees, but due to proximity to structures and potential for interference with utility services or traffic safety as listed in Criterion A. The requested removal and replacement complies with landscape standards and does not diminish the appearance of the subject site. B. Whether the proposedfelling is consistent with State standards, Metro Plan policies and City ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. The trees proposed for removal are located within an existing urban retail setting, with twenty two (22) trees located along Gateway Street and the remaining trees located in parking lot planting areas. The environmental quality of the site or the surrounding 'area will not be significantly impacted by the trees' Temoval because the trees are in parking lot planter islands and not in substantial groupings of trees and thus do not provide windbreaks for adjacent trees. Removal of the trees is not expected to have an adverse impact on any other trees in the area; they are not located in close proximity to trees to be retained and the remaining trees will be protected prior to removal (see plan sheet TP I). C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. The site is subjeet to an approved Site Plan and Development Plan (Jo. No. 88-03-35). Coneurrentiy with this application, the applicant is submitting an application fOT Site Plan Review Modification to the existing Site Plan and Development Plan. Contingent upon approval of the Modifieation applieation, the tree removal proposed herein is necessary in order to build the proposed L TD transit station. D. In the event that no Development Plan has been approved by the City,felling of trees will be permitted on a limited basis consistent with the preservation of the site'sjUture development potential as prescribed in the Metro Plan and City development regulations, and consistent with thefollowing criteria... Whether the applicant's prbposed replanting of new trees or vegetation is an adequate substitute for the trees to by felled Replacement trees are of a 2" caliper in accordance with SDC 4.4-105(E)(I) and (F). Replacement is proposed to occur on a one-to-two and a half basis with 28 trees removed and 77 trees planted. In accord~nce with SDC 4.4-1 05(F), parking lot planting area replacement. trees and tree types meet city street tree standards set forth in the Springfield Engineering Design Standards and Prosedures Manual. Therefore, the proposed planting plan (sheets L2.l and L2.2) adequately replaces the existing trees with approved types and sizes of trees in appropriate locations in compliance with this eri'terion. . F Whether slash left on the property poses significant fire hazard or. liability to the City. All trees and slash will be femoved from the site within 72 hours. No slash or other.fire hazard posing liability to the City will resultfrom the proposed removal of the trees. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Orekon region. The proposed' tree felling is consistent with the specified guidelines. The Oregon Department of Forestry, through its COJ.nmunity and Urban Forestry program, advocates for selecting appropriate tree species based on site conditions, avoiding,invading exotics, and reforesting the urban environment. As discussed above; the applicant is proposing replacementplantings at a rate of two and three quarters to one and has chosen species from Springfield's approved species list that are compatible with commercial scale development. Tlierefore, the Oregon Department of Forestry obJectives have been met by this tree felling proposaL H Whether transportation of ~quipment t; and equipment and trees ji-om the site can be' accomplished without a major disturbance to nearby residents. Construetion.access to the site will be from Gateway Street and Harlow Road and therefore ~ -. will not pass through residential neighborhoods. Treefelling activities will take place between the.hours of 8:00 am and 5:00 pm Monday through Saturday and will be of .limited duration. Therefore, transportation of equipment and trees from the site will be accomplished without a . major disturbance to nearb~ residents in compliance with this criterion. VI.
