Two (2) Copies of Title Report or Subdivision Guarantee for the parcel being
divided. The title reportmust be dated within 30 days of submittal at.the time of the final
submittal. An older report is OK at the pre-submittalstage.
Two (2) Copies of Each ofthe Reference Documents and Plats listed on the plat.
Two (2) Copies of Each of the Supporting Documents - the vesting deed (must vest
title to the owner listed on the plat), existing easement deeds, and documents listed as
exceptions in the title report, etc.

Two (2) Draft Copies of Any New Easements or Restrictions being created by
separate document/improvement agreements, maintenance agreements, joint use
ingress/egress and utility easements, sewer hook up in lieu of assessment, and any other

Two (2) Copies of a Consent Statement (Concurrence) on the plat (to be signed by
the lender prior to final approval) OR Two (2) Copies of an Affidavit of Consent by
separate document is required from all Trust Deed, mortgage, or other secured loan
interest holders against the property to be recorded simultaneously with the plat IF any
public dedications or easements are being made and/or any other interests are being

WRITTEN STATEMENT
FOR THE FINAL SUBDIVISION PLA TApPLICATION
This application is a submittal of the final partition plat for the property located at 3861 'E'
Street. The subdivision was granted conditional approval on October 25, 2007 under Case Number
SUB2007-00050: This application contains copies of the lender concurrence paperwork .that has been,
provided to Laura Foumal. Completed conCUrrences will be obtained prior to submittal of mylars.
The following is a discussion of how the final plat conforms to the conditions of approval placed on the
tentative subdivision "application:
1) The proposed private vegetated soakage shall be fully vegetated with all vegetation species
established prior to approval of Final Plat. Alternatively, if this condition cannot be met, the
applicant shall provide and maintain additional interim erosion control! water quality measures
acceptable to the Public Works Department that will suffice until such time as the filter strip
vegetation becomes fully established.

4) Prior to approval of the Final Plat, the common driveway shall be paved 18' wide from the front
property line to the pan of the last lot and constructed to support an 80,000 lb load.

legible from E Street. The signage shall be in accordance with Springfield Fire Code 505.1:
Premises Identification.
Permanent address signagefor Lots 2-5 will be postedfor each of the new homes prior to issuance
of the occupancy permit as assigned by the Building Official and will be clearly identified with
permanent signage placed in a position that. is 'plainly visible and legible from E Street. The
signagewill be.in accordance with Springfield Fire Code 505.1: Premises Identification.

RECITALS:
I) WILLIAM E. CURRAN, ROSEMONT VILLAS LLC, AND TITAN DEVELOPMENT
LLC, Grantors, are the owners of the lands described in the Deed that was recorded
November 3, 2006 at Recorder's Number 2006-079719, in the Warranty Deed that was
recorded August 17,2007 at Recorder's Number 2007-058135, and in the Bargain and Sale
Deed that was recorded July 19,2007 at Recorder's Number 2007-049059, respectively, all
in the Official Records of Lane County, State of Oregon, herein after referred to as .
DECLARANTS.
2) The owners are dividing said real property into six lots as shown on Subdivision Plat No.
2008-P as subdivided and recorded in Lane County Oregon Plat Records.
3) The owners desire to create easements and define maintenance responsibility on certain areas
and facilities for the benefit of future owners of the lots as described below.
DECLARATION OF EASEMENTS:
A) Easement Created: DECLARANTS hereby create a perpetual easement for the benefit of
Lots 2, 3, 4, and 5 over that certain area designated as "28.00' PRIVATE JOINT USE
ACCESS, UTILITY AND DRAINAGE EASEMENT" on said subdivision plat as said
easement lies in Lots 1,2,3,4, 5, and 6 for private access and utility purposes.
B) Easement Created: DECLARANTS hereby create a perpetual easement for the benefit of
Lots 2, 3, 4, and 5 over that certain area designated as "28.00' PRIVATE JOINT USE
ACCESS, UTILITY' AND DRAINAGE EASEMENT" on said partition plat as said
easement lies in Lots 1,2,3,4,5, and 6 for private storm drainage and treatment purposes.
C) Exclusion ofPUEs: Notwithstanding any other language herein, these easements do not
allow the placement of private utilities within any Public Utility Easement except for
crossings. .
D) Use of the Burdened Prooertv: The owners or occupiers of the lots affected by these
easements shall have the right to use their property, including the areas described as the
easements, for any ptupose as long as the owners or occupiers do not interfere with the use of
the easements as granted by this instrument. No vehicle parking or storage of vehicles shall
be allowed by any party within the easement area, including the agents, employees, tenants,
and invitees of said owners.
E) Maintenance and Reoairs: The cost of any maintenance or repair of the driveway and
storm drainage improvements within the easement area shall be split equally between the
owners of Lots 2, 3, 4, and 5. The cost of any maintenance or repair of private utilities lying
within the easement areas will be the responsibility of the owner of the respective facility.
F) Successors in Interest:The provisions of this instrument touch and concern, and relate to the
use of Lots 2, 3, 4, and 5 of said subdivision, and are intended to be covenants and
restrictions running with the land. All provisions of this instrument, including the benefits
and burdens, are binding and inure to the heirs, successors, assigns, transferees, and personal
representatives of all owners of any of the aforementioned lots.
