to-month basis, but he has since vacated said premises.

Defendants J. I. Case, Company and Chria Schoap have
defaulted and,their respeative defaults have been eritered of

" Since the, declaration by resolution of the plaintiff I s Board
of Directors referred to in Paragraph 3 above, plaintiff has
a.ttempted to agree with the 'owners ,of Baid real. property, the
defendants ~picer, with respect'to the llompensation to.be pa~d
for eaid property and the, damages,.1f any, 'tor the taking
thereof, but plaintiff and said defendants Spicer 'have been
unable to reach agreement conoerning the same.

On February 24. ,1987, plaintiff made a written, offer to
,defendants Spicer to purohase their satd real property desc~ibed
inRExhibit Bit and to pay the sum of 'Two Hundred F1ft,een Thousand
Four Hundred Forty-a1~ Dollars aa aompensationthereforand for
,any compensable damages to the remaining, property of defendants
Spicer, but Baid ~ffer has been rejected.

In June 1988, plaintiff received revised appraisals of said
real property and determined ,just compensation to be the Bum of '
~~89,729.00 including compensation for said real property and any
compensable damages to the remainder and on June 22, 1988,
plaintiff offered ,'said sum of $189,729.00 to Defendants Spioer in
writing, but said offer bas been rejected.
