EASEMENT
KNOW ALL MEN BY TIlESE PRESENTS, that the under.i;gned Lane Transit DiStrict. for a good and valuable consideration,
the receipt whereof is hereby acknowledge, do(es) hereby grant unto the City of Springfield, a municipal corporation, acting
by and through its SPRINGFIELD UillI1Y BOARD, and unto its sucoessors and assigns, a pe1pCloal easement along with
the right to enter upon the lands of the undersigned sitoated in the City of Springfield, Stale of Oregon, and more particularly
described as follows: .
A ten foot wide easement, five feet either side of the as-constructed centerline of a 16 inch diameter waterline, as shown on the
attached Exhibit "B", pla~ at the direction of the Owner'within the property described as follows:
The northerly thirty (30.00) feet of the property acquired by the Lane Transit District by that deed recoIded November 12, 1987
at Ree11486R, Reception No. 8749822 in the Lane County Official Reconls, Lane County, Oregon and aJsc the northerly thirty
(30.00) teet of that property appropriated to the Lane Transit District by that Judgement entered by the Cin:uit Court of the Stare
of Oregon for Lane County in Case No. 16-87-Q5204. Said thirty feet running from the easterly right-of-way line of Glen wood
BoulevaJd to the westerly right-of-way line of Henderson BoulevaJd in Glenwood, Oregon; a distance of 898.51 fee~ more or
less.
Said easement containing 8,985 square feet within Tax Lot 301 of Assessor's Map 17-03-34-34.
And to construct, operate, maintain, and replace therein underground facilities including power, fiber, and control lines and
water pipelines. SUB shall have a right to pennanently maintain the underground facilities, and its agents and employees shall
have the _ right to go upon said real property for the purpose of constrncting. - operating, maintaining. and repairing the
underground facilities, to remove and replace fences," lawns, and trees to the extent necessary to construCt, operate, maintain.
and protect said lines and facilities, provided'SUB shall leave the real property-in the same condition as before. excluding
reasonable, fair wear and tear arising from such activities. No part of any building containing sanitation facilities or any
permanent structure will be placed in the 'easement areas, other thail pavement. curbs, sidewalks. and driveway aprons made
with such materials as Grantor deems appropriate. without the express consent of SUB.
The undersigned covenants that it is the owner of the above described property and that such' property is free and clear of
,encumbrances and liens of whatsoever character except all covenants. coriditions.,festrlctions. encumbrances, easements..and
liens, if any , affecting title which appear in the public recoId" any of those visible from a physical examination of the propeity.
