I spoke to Jim about the review process needed for approval of the current use at 244 39th Street. Jim
determined that a Formal Interpretation would not be needed to include boat repair since it is similar to other
allowable uses in the zone. The two reviews that would be needed are Site Plan Review and Drinking Water
Protection Overlay application. The areas of gravel or unimproved areas where he is storing motorized boats,
cars and RV's awaiting repair plus enough required customer/employee parking for the size of the building will
need to be paved (will be over 5,000 square feet) and the property is adjacent to residential which requires Site
Plan Review. The site is in a 20 year Time of Travel Zone for DWP review.
I called Mr. McDougal to let him know and .<.'~..d him to the website for the applications. I asked him to have
the applications submitted in 30 days (by June 30) or to contact me if he could not meet this deadline (it may take
longer since he will have to work with an engineer on the Site Plan Review).

The City received a complaint that the property listed above is in violation of a Springfield
City Code and/or ordinance. Rather than issuing a citation or taking immediate legal action,
it is the City's standard practice to infonm citizens of the violation and request that it be
corrected.
SPECIFIC VIOLATION: Section 5.002(4)(10) of the Springfield City Code. Used materials
and stored, damaged and/or inoperable vehicles. The complaint involves the numerous
stored vehicles, used materials and whether the business was really penmitted to operate in
this manner.

REQUIRED CORRECTION: In an effort to eliminate conditions which may adversely affect
community economic stability and to promote pleasant neighborhoods, all used materials
must be stored within a legally permitted building unless it is in connection with a business
enterprise, lawfully licensed by the city, and properly operated in the appropriate business
zone, pursuant to the zoning laws of the city.
In an effort to eliminate conditions which may adversely affect community economic stability
and to promote pleasant neighborhoods, it is unlawful to park, store, leave or permit the
parking or storing of any licensed or unlicensed motor vehicle upon any public or private
property within the city, unless completely enclosed within a legally permitted building that is
wholly or entirely enclosed except for doors for use for ingress and egress unless it is in
connection with a business enterprise, lawfully licensed by the city, and properly operated in
the appropriate business zone, pursuant to the zoning laws of the city. No land use
approvals are on record to authorize the use of this property for the current activity. The
zoning of this property is LMI Light Medium Industrial. Boat repair is permitted only in the
commercial zoning districts. Contact Springfield Planning staff to detenmine what uses could
be penmitted and the necessary land use process to obtain for those uses to remain. Unless
land use approval can be obtained all use of the property must cease.
In order to avoid actions being taken against you or your property we encourage you to
proceed quickly. In the event that you have not taken corrective action by the assigned time
deadline, a civil infraction citation will be issued to the resident and/or property owner. Civil
Infraction fines: $500.00 first offense/$1ooo.0o second offense. Each day a violation
continues constitutes a separate offense and citations can be issued daily.
DEADLINE FOR COMPLIANCE: Thirty (30) days from the date of this notice.
