Re: Market street LDS Church project
Dear Richard:
I have reviewed your letter dated August 20, 1992 regarding the
meeting we had to discuss the above referenced project, and have
the following comments:
1. Item No. 6 regarding the time-clock swith for the exhaust fan
in the womens restroom was in response to a concern voiced by
the custodian, and is not required by code. I do understand
the custodians concern, and agree that ventilation of the
toilet room can be a problem if the light is turned off, since
the exhaust fan control is linked to the light switch.
2. The second part of Item No.7, regarding low water pressure at
the janitors sink, is also a comment from the custodian. Our
records indicate that the womens restroom, adjacent to the
custodial closet, was remodeled in 1984. You may inquire if
the water pressure was better before the remodel. I cannot
determine any reason why the pressure at the janitors sink
should be a problem if pressure at other plumbing fixtures in
the same portion of the building is adequate.
3. with regard to your additional questions regarding this
project, I spoke with Gary Karp, Associate Planner, since the
questions were land-use related. Gary indicated that the
Church is operating under an existing conditional use permit,
and this use approval will remain in effect as long as no
major change or expansion is intended. Due to changes in the
city Development Code, the Church is now a pre-existing non-
conforming use since one criteria now is that the Church take
access from a collector or arterial street. Neither Market
street nor Carter Lane, which border the Church property in
the front and rear, are collector or arterial streets. As a
result of this non-conforming situation, the proposal by the
Church to acquire adjoining property for parking lot expansion
is a problem since no expansion of the conditional use
approval could be granted. If you wish to discuss this
further, I recommend contacting Gary Karp at 726-3777.

4. It appears that no impact statement would be applicable, since
no expansion of the Church property beyond what exists now
could be approved.
No flood control design is required, as this parcel is not in
the floodplain.
As I mentioned, the parking situation which exists in the
front of the Church property (all spaces backing out into
Market street) would not be allowed if a similar request were
made today. The city will take no action to force this
situation to be altered as long as the use is not intensified
or changed to increase the non-conformity.
