HomeMy WebLinkAboutEasement APPLICANT 12/12/2008 \ Division of Chief , ~uty Cle~k Lane County Deeds and Reco~ds , , I STORMW A TER EASEMENT Dukes and Dukes Construction,Inc., an Oregon Corporation, GRANTOR (owner of Lot 10 of Dove Estates) conveys to the Dukes and Dukes Construction, Inc., an Oregon Corporation, GRANTEE, (Owner of Lot 9 of Dove Estates) an easement over, across, and under the following described land and real property: A strip of/and lying in the southeast one-quarter of Section 28, Township 17 South, Range 3 West of the Willamette Meridian, in Lane County, Oregon, said parcel being a portion of that tract of land shown in the Subdivision Plat for Dove Estates as platted and recorded in Reception Number 2008-016284, Lane County Oregon Plat Records, said' parcel being more particularly described as follows: A strip of/and, 5 feet in width parallel to and,adjacentto the south line ofLot,9 of Dove Estates, beginning at the West property line of said Lot 9 and extending east 10 feet. . for a private roof drainage system as constructed and located below the surface of the real property, as the same has been surveyed and located over said real property by the Grantor. The Grantor and its contractors, subcontractors, agents or employees, shall have the right to go upon said real property for the purpose of maintaining said system. The said system shall be so constructed so as to do no damage to said real property, , The Grantor shall have the right to permanently maintain said system over said real property, and its agents and employees shall have the right to go upon said real property at the points where the said system shall be located and constructed, for the purpose of maintaining and repairing the system with the understanding that the Grantor, its agents or employees, in maintenance or repairing of the system, shall do no damage to the real property, and shall leave the real property in the same condition as before, No permane~t building shall be erected'or placed in the easement area. Subject to the foregoing limitation Grantor may use said easement area for roadway, parking, or landscape purposes, or for any other purpose not inconsistent with said easement.
