. Applicant Response - taken from written statement addressing compliance with conditions
of approval, accompanying the Land Division Plat application PRE2007-00067 dated
9/25/07.
Condition #1: Prior to Plat approval, the applicant shall provide evidence of an approved facility
permit from Lane County for access to Parcel 2i OR record a joint use access easement across
Parcell to benefit Parcel 2 and allow access from Pheasant Boulevard [SDC 32.020.(1)(c)).
Applicant Response: A draft copy of a 'Grant of Temporary Access Easement and Maintenance
Agreement' creating a 20-foot wide joint use access easement over Parcel 1 to provide access to
parcel 2 from Pheasant Boulevard is included with this submittal. This easement is to be created
by separate document, but has been shown and dimehsioned on the final plat. Spaces for future
recording information for this easement have been provided on Sheet 1 of the final plat. Please
note that this document includes provisions for vacation of this easement and revocation of
associated rights upon acquisition of an approved Lane County Facilities Permit and construction
of driveway improvements for access from Game Farrr Road at the time of development of
Parcel 2. :'

Staff Finding: Public Works Transportation has reviewed Condition #1, as well as the
,
applicant's response, and has concluded that the temporary access easement is acceptable for
meeting this condition. : .

Condition #2: Prior t~ Plat approval, the applicant shall provide maintenance agreements for
the private storm sewer system between lot 2708 (parcels 1 and 2) and lots 2709 and 2710
[SDC 32.i20l5)(a)). I

Applicant R~sponse: An existing 4' Private Stormwater Easement, created by means of Land
Partitioh;pfat No.: 2004-P1750 as shown and referenced on the final plat, already exists over the
private stormwater improvements in question. This e~sement is already in full compliance with
the applicable provisions of SDC 32.120(5)(a). On behalf of the applicant, we hereby
respectfully assert that maintenance obligations for th1e private stormwater improvements

contained in the easement are provided for according ,to the provisions of ORS 105.175(3)
(highlighted copies of which are attached hereto) and [that cre,ation of a maintenance agreement
by separate document would be'superfiuous and unnecessary. For purposes of clarification, a
note has been added to the final plat stating that "Partels 1 and 2 hereon and Parcels 1 and 2 of
Land Partition Plat No. 2004-P1808 as shown hereon are subject to joint maintenance, in
accordance with the provisions of Section 105.175 of the Oregon Revised Statutes, of private
stormwater improvements either existing or hereafter: constructed within the existing Private.
Stormwater Easement created by means of Land Partition Plat No. 2004-P1750 as shown and
referenced hereon." .. .
Staff Finding: Publ,icWorks Engineering has reviewec\! Condition of Approval #2, as well as the
applicant's response, and has concluded that the clarification on the final plat.is acceptable for
meeting this condition. .:

Heads Up Comments: !
I
1. A site visit by Planning and Public Works Engineering on 10/2/07 revealed that the
property owner has violated several of the conditions' of approval of DRC2006-00026, the
Tree Felling Permit for the subject property. As a result, the owner/applicant is advised
that the land division plat approval will be delayed while Planning addresses the tree
felling permit violations.

THIS IS NOT A DECISION ON. THE PLAT. The plat pre-submittal meeting sha'lI be held within
one year of'the date of the Land Division Tentative approval. A complete LandDivision Plat
application shall be submitted within 180 days of the pre-submittal meeting. If the applicant has
not submitted the Land Division Plat application within these time frames, the Land Division
Tentative approval shall become null and void and re-submittal of the Land Division Tentative
application shall be required perSDC 5.2-140. .

Land ~ivision Plat Application Process (see next page for a diagram of this process)
1. Applicant Submits a Land Division Plat Application for Pre-Submittal
. The application must conform to the Land Division Plat Pre-Submittal Requirements
Checklist on pages 5 & 6 of this application packet. '
. The purpose of pre-submittal is to ensure the applicant has all items necessary for a
complete s.ubmittal.
. A pre-submittal meeting to discuss completeness is inandatory.
. Pre-submittal meetings are conducted every Tuesday and Friday, from 10:00am -
noon.
. We strive to conduCt'the pre-submittal meetings within five to seven wo'rking dilYS of
receiving the application. '
, 2. Applicant and the City Conduct the Pre-Submittal Meeting
, . '
. The applicant, owner, and design team are strongly encouraged to attend the pre-
submittal meeting. I
. The meeting is held with representatives.from Public Works Engineering and
Transportation, Community Services (Building), Fire Marshall's office, and the Planning
~~oo. I
. The meeting is sche.duled for 30 to 60 minutes.
. The Planner provides the applicant with a Pre-Submittal Checklist at the end of the
meetin'g specifying the items required to make the application complete if it is not
already complete. I
. The applicant will then have 180 days to make the application complete for submittal

3. Applicant Submits a' Complete Land Division P,lat Application
. 'cWhen the applicant has addressed all items ~>n the Pre-Submittal Checklist and the
,City Surveying Section has notified the applicant's surveyor that the plat and other
documents are sufficiently refined, the applicant can submit a complete application to
the City Survey Section located in the NW'Quad of City Hall.

4. Applicant Records Plat at Lane County &. Submits Plat and Documents to City

applicant's surveyor at.Lane County.
. After plat has been recorded at Lane County, applicant submits five (5) recorded,
rolled paper copies of the plat and three (3) copies of required documents to the
Development Services Department prior to the issuance of building permits.
