Carol,
. Since you're heading out of town, I wanted to update you regarding Game Farm Dental.
Jim and I decided that the deed restriction should be as follows': It should be placed'on the entire property prior to
recording the plat at the county and should require compliance with the City of Springfield Tree Felling Permit
decision DRC2006-00022. As such, re-vegetation of the site will occur through the Site Plan Review process for
each parcel and will occur in accordance with !he Vegetation I Re-v.egetation Plan for the Game Farm Road
Grove, dated September 11,2002 by Ann Christiansen, to the extent practical.
Essentially, we don't want to put a'number on the re-vegetation nor state how many trees need to be re-planted
on each parcel. Rather, as each parcel gets developed and goes through Site Plan Review, we will require as
many trees as will fit on the two parcels according to the respective development plans. Realistically, between
street trees, landscaped setbacks, parking lot planting areas, and vegetated stormwater treatment facilities, it
shouldn't be too difficult to account for the required re-vegetation of all of th!l. trees that were actually.removed.

Please 'provide me a copy of the recorded deed restriction once that happens. Also, Joe Leahy has been
communicating with Mr. Spickerman regarding resolution of the ~orrective tree felling issue. '

I need a Deed Restriction (a restrictive covenant is something tt:at would be in a homeowner's association
cc&r's). The Deed restriction applies to both lots and will need to' be recorded prior to the plat being recorded at.
the county. I have to talk to Jim about the tree count and how the deed restriction should be worded - we were
going to make the re-vegetation determination when we got the :corrective tree felling permit, but since that issue
hasn't been resolved yet we'll have to make the re-vegetation determination and decide on deed restriction
language now. I'll try to talk with Jim on Monday about the wording of the deed restriction and get back to you
and SS&W then. .
