WRITTEN STATEMENT
FOR THE FINAL>P ARTITION PLAT APPLICATION
. Tills application is a submittal of the [mal partition plat for the property located at 300
33'd Street. The partition was granted conditional approval on October 25,2007 under Case
Number SUB2007-00051.'
The following is a discussion of how the final plat conforms to the conditions of approval
placed on the tentative partition application:
I)
Prior to plat approval, the approval, the applicant shall execute and record an Improvement
Agreement for both B Street and 33'd Street for paving, curb, gutter, sidewalk, street
lighting, and stormwater.
An Improvement Agreement for the required facilities is included with this application.
2)
Excavation or filling in the vicinity of the existing street trees, as well as any future
removal of these trees, must conform to the standards of the SDC and EDSPM. Since these
street trees are located on private property, maintenance of the trees shall be performed by
the' property owner as per SDC 4.2-140 C.2.
This has been noted.
3)
Prior to plat approval, three new street trees of at least two inches in caliper shall be planted
either in the right-of-way between the property line and top of bank or, if that is not
feasible, in the street side yard setback on Parcel 2. New street trees shall be selected and
installed as specified in the EDSPM and shall conform to any easement stipulations for the
proposed seven-foot public utility ea~ement (PUE) along the frontage of Parcels I and 2. .
Depending on the selected location of these trees, maintenance shall be performed by the
property owner or the City as per SDC 4.2-140 C.
The street trees have been installed. '
4)
Prior to occupancy, Parcel 2 shall be serviced with a six-inch lateral from the eight-inch
sanitary sewer main in the PUE along the north property line as depicted on the tentative
plan. >,
This will be addressed at the time the building permits are issued.
5) Prior to occupancy, electrical service shall be extended from Pole #80219 to serve Parcel 2.
Placement of such electric facilities shall be in the,existing 14-foot PUE,along the north
side of the subject property and shall be underground as conditioned in the Underground
Placement of Utilities section below.
This will be addressed at the time the building permits are issued.
6) During residential development, all new utilities to serve Parcels I and 2 shall be installed
underground in accordance with SDC 4.3-125. .

7) Prior to occupancy, Parcel 2 shall be connected to the water system as proposed on the
tentative plan and in accordance with SUB Water Division standards.
This will be addressed at the time the building permits are issued.
8) .' Prior to plat approval, the applicant shall record and document a seven-foot PUE along the
street frontage of Parcels I and 2.
A PUE dedication is shown on the plat.
9) Prior to plat approval, the applicant shall record and' document'an additional three-foot
PUE adjacent to the south side of the existing 14-foot PUE along the north property line of
Parcels I and2.
A PUE dedication is shown on the plat.
10) Prior to plat approval, the applicant shall remove the carport on the subject property from
the easement area on the west side ofthe property. .
The carport has been removed.
II) Prior to plat approval, the area of the fence along the west property line that protrudes into
the vision clearance area shall be scaled back in accordance with SDC 4.4-115.
The fence is not owned by the developer and is unable to be altered.
12) Prior to occupancy, vehicle parking shall be provided to serve Parcel 2 in accordance with
SDC 4.6-125.
This will be addressed at the time the building permits are issued.
13) Future development on Parcel 2 may;not include placing any building or above-grade
. structure, excej)t a fence, upon or over the ten-foot easement area on the north side of the
subject property as per SDC 3.2-215.
A note has been included on the plat.
14) Future development on Parcels I and 2 shall abide by the base solar development standards
as per SDC 3.2-225.
A note has been included on the plat.
15) Prior to plat approval, the applicant shall record a deed restriction stating that access to
Parcel 2 shall be limited to a single access point, located as for north as is reasonably
possible, approximately 35 feet south of the ,interseCtion of the north and east property
lines.
A Declaration of Restriction document is included with this application.

16)
Prior to occupancy, access shall be provided to Parcel 2 in accordance with the deed
restriction conditioned above and shall conform to the requirements ofSDC 4.2-120 C.
This will be addressed at the time the building permits are issued.
17)
Clear areas shall be maintained at each access to a public street and at the intersection of
33rd Street and B Street as perSDC 4,2-130.
