The applicant owns three contiguous tax lots constituting one development site at the
intersection of 42nd Street and E Street in Springfield, Oregon, The subject property is
the former 42nd Street branch ofN0l1hwest Community Credit Union and majority of the
subject property is developed with the structure that formerly housed the bank and
associated parking areas, The remainder of the subject property is'vacant (17-02-32-23
TL 300), The development site is split zoned; the majority of the site is zoned
community commercial consistent with the use that has been taking place on the subject
property for many years, However, a small piece ofthe northern portion of the site (17-
02-32-23 TL 300) is zoned Heavy Industrial. The two most northern tax lots are shown
as being planned for Heavy Industrial use in the Metro Plan and they are also shown as
being planned for Heavy Industrial Use in the applicable refinement plan, the Mid-
Springfield Refinement Plan,
The applicant is interested in undertaking a zone change and any other applications
required to zone the Heavy Industrial portion of the site for Community Commercial use,
The applicant is also interested in eliminating the plan/zone conflict on the development
site, As noted by the applicant, the majority of the site is already zoned Community

Commercial and is used for Community Commercial purposes, None of the site has been
used for Heavy Industrial development since at least 1986, The applicant believes that
there is support for this application found in the text of the applicable refinement plan in
both the Commercial and Industrial portions of the plan, Perhaps most relevant is the text
on Page 9 of the Refinement Plan:
Recognize existing commercial uses along Main Street and North 42nd Street, and
provide certainty in the commercial land development process by specifically designating
commercially used land as commercial.
As noted the development site is used for commercial purposes and the no industrial
activities take place on-site. Furthermore, the applicant submits that the northern portion
of the site is too small to be of any great utility to an industrial user. As such, the
applicant and his agent believe the site is appropriate for commercial
zoning/development.
The applicant also believes that the required process shall be a Refinement Plan Diagram
amendment and a zone change for 17-02-32-23 TL 300 and that a Refinement Plan
diagram amendment will be required for 17-02-32-23 TL 400 to eliminate the plan/zone
conflict. The applicants' agent is under the impression that the Refinement Plan
amendment is one application for both properties, The reasons the applicant believes that
a Metro Plan diagram amendment is not required are twofold: the Refinement Plan
diagram amendment shall automatically amend the Metro Plan diagram map; and, the
Metro Plan diagram is only site specific as provide in the Metro Plan text where the
property does not abut more than one zoning designation, The properties under
consideration abut two zoning designations,

3, How does the planned UGB expansion affect this application, if at all?
4, If the applicant does not proceed with the zone change is there a mechanism
by which can the applicant redevelop 17-02-32 TL 300 and provide parking
for the new commercial use on 17-02-32-23 TL 300?
5, If the applicant does not proceed with the Refinement elan Amendment! Zone
change on 17-02-32-23 TL 300 what ifany mechanism is there available to
address the plan/zone conflict on 17-02-32-23 TL 400?
