HomeMy WebLinkAboutResolution 09-04 02/02/2009 CITY OF SPRINGFIELD RESOLUTION NO. 09- 04 A RESOLUTION OF THE CITY OF SPRINGFIELD COMMON COUNCIL MODIFYING A LIST OF CAPITAL IMPROVEMENTS TO BE FUNDED BY SYSTEMS DEVELOPMENT CHARGES, INCREASING A SYSTEMS DEVELOPMENT CHARGE AND SETTING AND EFFECTIVE DATE. WHEREAS, on December 4, 2000, the City adopted a methodology to be used for setting rates for systems development charges; and WHEREAS, on December 4, 2000, the City adopted a Systems Development Charge Project List which details those projects which are eligible for expenditure of Systems Development Charge revenues; and . WHEREAS, since the adoption of the Systems Development Project List there have been a number of transportation projects that have been constructed and a number of transportation projects which have been planned for future construction; and WHEREAS, a number of these newly planned projects are eligible, in whole or in part, for expenditure of System Development Charge revenues; and WHEREAS, ORS 223.309(2) provides that a City may modify the list at any time; and WHEREAS, the City Manager has recommended that the list be modified to include new projects, and to conform the costs of projects on the list to current estimates of project cost; and WHEREAS, the City Manager has advised the Council that if these changes to the list are made, the calculations in the methodology adopted on December 4, 2000, would result in an increase in both the reimbursement and the improvement component of the Transportation Systems Development Charge; and WHEREAS, ORS 223.309(2) requires that if a change in a project list would result in an increase in Systems Development Charges, the City must give at least 30 days notice of the proposed change to those persons who have requested notice pursuant to ORS 223.304; and WHEREAS, on December 11, 2008, the City gave notice to the persons who had requested such notice by depositing a letter, a true copy whereof is annexed hereto as Exhibit 1 and by this reference incorporated herein, all postage being paid, into the custody of the United States Postal Service; and WHEREAS, the City Manager has advised that if the proposed project list is adopted, the current methodology would result in an increase in Transportation Systems Development Charges as follows: the reimbursement component of the Transportation System Development Attachment 2, Page 1 of 4 Charge would increase to $48.30 per trip and, and the improvement component of the Transportation Systems Development Charge would increase to $176.04 per trip end, for a combined Transportation System Development Charge of $224.34 per trip end; and WHEREAS, ORS 223.309(2) further requires that if a public hearing is requested in writing within seven days of the date the proposed modification is scheduled for adoption a public hearing shall be held; and WHEREAS, as of January 13,2009, the Home Builders Association of Lane County filed a written request for a public hearing; and WHEREAS, the City duly gave notice that on January 20,2009, a public hearing will be held on the matter of the adoption of the modification to the project list and did, on said date, conduct a public hearing; and WHEREAS, the Council has considered the information provided by the City Manager and the comments at the public hearing; NOW, THEREFORE, BE IT RESOLVED, that the Council finds and determines that the proposed modification to the System Development Charge Project List is appropriate and that adoption of the proposed modification to the Systems Development Charge Project list is in the Public Interest; and BE IT FURTHER RESOLVED, that the rate of the Transportation System Development Charge is fixed as follows: the Reimbursement component shall be $48.30 per trip end and the Improvement component shall be $176.04 per trip end, for a total Transportation System Development'Charge of $224.34 per trip end; and BE IT FURTHER RESOLVED, that this Resolution shall take effect as to one and two-family residential developments on October 16 ,2009 and as to all other developments on March 15 , 2009. FAX: (541) 726-3621 www.ci.springfield.or.us/depLpw.htm www.ci.springfield.or.us December 11, 2008 Interested Party List Dear Interested Party, ORS 223.309(2) provides that any local government that maintains a list of capital improvement projects that it intends to fund, in whole or in part, with revenues from an improvement fee component of a Systems Development Charge may modify such list at any time. On November 24, 2008, City staff advised the Council that it had prepared a draft change to the existing capital improvement project list which will be funded from the improvement fee component of the City's Transportation Systems Development Charges. A copy of the capital improvement project list is attached for your reference. At that time, staff also advised Council that based upon that capital improvement project list, it would submit for Council review and approval a resolution which would, if adopted, increase the Transportation Systems Development Charge. ORS 223.309(2) further provides that if a change to the list will result in an increase in Systems Development Charges, the local jurisdiction must give notice to persons who have requested notice pursuant to ORS 223.304(6) at least 30 days in advance of the date the proposed modification is scheduled for consideration and possible adoption. You are a person who has requested such notification. Accordingly, this letter is notice that the Council will consider for adoption the attached project list, and a resolution increasing the Transportation Systems Development Charge, on Janumy 20, 2009, at the Council meeting to be held in the City Council Chamber, 225 Fifth Street, Springfield, Oregon, beginning at 7:00 p.rn., on such date, or on such adjourned date as the Council may direct. The statute further requires that if a written request for a public hearing is received at least seven days before the date of Council consideration of such resolution, then a public hearing shall be held at the time the list and increase in System Development Charge is considered for adoption. Staff has tentatively scheduled a public hearing to be held on that Janumy 20 public meeting date. However, the Council has the authority to not hold a public hearing if a written request is not received at least seven days before the scheduled Janumy 20, 2009 public meeting.
