Dahlen Trust, dated December 20, 2002, ("Trust") is the owner of real property described in the attached Exhibit A (Parcel No.1) and is the owner of real property described in the attached Exhibit B (Spencer Glenn); , B. Spencer Glenn is a subdivision, created 'pursuant to Lane County and State of Oregon regulations, as depicted on the subdivision ,plat of Sp,encer Glenn, recorded with Lane County of even date herewith (a pre-recordation copy Sheet! 1 of 3 of the plat is attached' as Exhibit C); C. Lane County issued Tentative Approval of Spencer Glenn (pA 03-5657) on June 29, 2004 with a condition that "An access easement shall be established at least 60 feet in width from South Willamette Street to the west property line serving Lots 2 - 5 and Map 18-04-24 #300 to the west." Spencer Glenn contains "Lots 2-5" (and contains Lot 1 also) and Parcel No. 1 is "Map 18-04-24 #300 as referred to by Lane County in PA 03-5657. D. It is intende<:i by this instrument to provide access from South Willamette Street to all five 10ts,of Spencer Glenn and to. Parcel I. Spencer Glenn Drive, as depicted on Exhibit C, is the driveway providing said access. ' E. Access from South Willamette Street to all Spencer Glenn lots and Parcel 1 is provided by the creation of easements through Lot 1 of Spencer Glenn and along the common boundary lines of Lots 2-5 of Spencer'G1enn. AGREEMENTS: l. The Trust, and all successive owners of lots within Spencer Glenn, each as a Grantor, grant and convey to each other, as Grantee, and to each other's heirs, successors and assigns, perpetual, nonexclusive easements for ingress, egress, and utilities, and use of the easements upon the terms and conditions of this Easement Declaration.. The easements are depicted on Exhibit C and described, in total (the entire length of Spencer Glenn Drive within Spencer Glenn), in the attached Exhibit D. ' 2. Each of the easements granted hereby is intended to be and is appurtenant to each of the parcels as provided in paragraph' 1. above and shall nOf be deemed merged by reason of the ownership of both Parcel No.1 and the lots of Spencer Glenn by tile Trust. Notwithstanding " such common ownership, the easements shall survive and c9ntinue infjJll. force and effect as easements appurtenant to each of the lots of Spencer Glenn and Parcel 1. and burdening each of the lots of Spencer Glenn and Parcell, as described above, and shall be for the benefit of each of the lots of Spencer Glenn and Parcel 1 and for the benefit df any successor in interest to the owners of each of the lots of Spencer Glenn and Parcel 1 (and any lawful subdivision thereof). ,The easements described in the attached Exhibit D, may be used by the owner of the benefited parcel to obtain access to and from the benefited parcel. The easements shall run with the land and be binding upon, apply, and inure to the benefit of the successors and assigns of the owners of the lots of Spencer Glenn and Parcell (and any lawful subdivision thereof). , 3. The maintenance and repair obligations of Spe)1cer Glenn Drive, as described in Paragraph 1., shall be shared by the owners of the lots of Spencer Glenn and Parcell, and their successors in interest, and shall include maintenance and repair of Spencer Glenn Drive and"its ditches, culverts, and shoulders. The maintenance "and repair obligations of the access road shall be shared equally by the owners.of the lots of Spencer Glenn and Parcell. 4. These easements are granted subject to all easements, reservations, restrictions, conditions, and encumbrances. of record affecting the subject I'wl'~"ies. 5. The terms and conditions of this Easement Declaration shall extend to and be binding upon and inure to the benefit of the heirs, successors and assigns of the owners of the lots of Spencer Glenn and Parcell. . . No waiver of any right arising out of a breach ?f any covenant, term or condition of this Easement Declaration shall be a waiver of any right arising out of any other or subsequent breach of the same or any other covenant, term, or condition or a waiver of the covenant, term, or condition itself. 7. If any legal proceeding is commenced for the phrpose of interpreting or enforcing any provision of this Easement Declaration the prevailing party in such proceeding shall be entitled to recover a reasonable attorney's fee in such proceeding, or any appeal thereof, in addition to the costs anddjsbursements allowed by law. 8. The owners of all property described herein covenant to dedicate to the public the entire width of the easements in the event that a public agency officially declares that such a dedication is needed in the public interest.
