I My initial take is that it will take some convincing on this end to say the agreement is obsolete, although it needs to be modified to meet your current needs, Isn't this where we talked about putting strategies for dealing with Public Works? Right now your Code requires fiscal impacts be mitigated through an A~nexation Agreement "or other mechanism approved by the City Council" so be sure that's addressed before you v.raive the condition in the annexation section of the Code. Hi PT & MB, APs: We are reviewing a condition of partition approval from an urban fringe property that is now coming up for platting, and it raises some questions about the prior use 'of Consents to Annexation and similar issues. I Attached is an "Annexation Agreement" form that was used previously as a means to obtain landowner consent to annexation through the land use approvals process. With the abolishment of the Boundary Commission and the City Council's philosophy of landowner-initiated annexation, this form seems obsolete. Additionally, the term "Notice of Annexation Agreement" implies that all the details of utility provision and landowner obligations found in a long-form Annexation Agreement have been addressed. We'd rather'not update the form with new citations to the OARs and Development Code if it doesn't need to be done. Staff are prepared to waive the condition of signing a consent to annex for this property as it's distant from the current City limits and there 'is no sewer availability in the foreseeable future.
