This would keep it a private street, but they would have to meet the setbacks and such to allow fora public street in the future. The easement document could contain some verbiage regarding future public dedication as well. A sample easement document is attached. (See Page 3, Item 8.) LPPN 91-P0165 is an example of a partition with a note about reservation for'future right-of-way. Because this plat is a little different in that it is outside the incorporated city, but inside the UGB, we have some concerns about the southerly strip outside of the plat that is being conveyed to the City, Does the City have the right to accept it if it is not within the incorporated city?
