Letter from Mr. & Mrs. Barnes RE: Potential Soil Contamination

The attached letter came to the Environmental Services Division from DEQ. It alleges that the former
structure on the lot located at the northwest corner of 19th and Hayden Bridge was used for meth
production, as well as alleging that chemicals had been dumped on'the property,
The subject property is commonly known as King Henry Estates. The developer has received subdivision
tentative approval (SUB2005-00030), has applied for subdivision plat approval (SUB2007-00019), and is
nearing completion of the PIP improvements (project No. P30463)."
Given the statements made by Mr. and Mrs. Barnes, I am concerned about allowing this plat to move
forward without furthe; investigation of these issues. My particular, concerns are in relation to accepting
the dedication public right-of-way or easements, and the subsequent public improvements, without some
assurance that the land is not contaminated - will the City assume some responsibility for the clean-up or
other future issues if we accept the public right-of-~ay and' improvements after we've been advised of the
potential contamination? Additional concerns include'protection of,!:he future property owners, the
neighboring properties, and the environment.
I understand that the subdivision plat is nearly ready for [mal approval from the City and subsequent
'filing with the County. Please review this letter and advise me as soon as possible whether the City has
legal grounds to withhold the plat approval until this iS,sue is resolved. In addition, please assess the legal
ramifications if the City moves ahead with approving the plat, accepting the public improvements, and
allowing building construction to proceed in the event that contamination is, in fact, found on the
property .

Dear Sir or Miss:
This is an open letter to severn! public agencies. Hopefully, through this method, someone will be
able to answer our questions regarding possible bealth risks that we may be exposed to in our .
neigbbomood and what can be done to limit those risks.
The property located on the comer of 19'" Street and Hayden Bridge Road in Springfield, Oregon, is in
the beginning stages of development - it has beeri divided into several housa lots and short roads bave
beeri put in to access those lots. For some time it had been one lot ~ with a home and severn!
outbuildings. The last residents of the home left evidence of drug manufBcturing, and like many of
our neighbors we saw the dumping of liquids from barrels and paint caris while they lived there. At
the time - and before the drug equipment was found after they left -'- we called the police and were told
that tbere WllS nothing they could do because "!NET' bad lost its funding. To mde a long story short,
thebome and all but one of the outbuildings were subsequently burned by the Springfield Fire
Department as a "training fire." When we were notified that the burning was to take place, I bad
called the fire department to warn them about tile drug manufacturing history (my brother is a
fWfighter in California, and I wouldn't want him to walk blind into a manufacture fire), and I was told
that they bad already heeD made aware of the problem by local law enforcement.
I would like someone to test the lots before building begins for, toxic or chemical residue. I would like
to know if those chemicals are in the ground warer (seveml ofus have irrigation wells), I would really
like for dust abatement restrictions.to be placed on the bUilders so that disturbed waste that turns
airborne - especially in the coming summer - won't hurt my children or the children of my neighbon;,
