Steps in the Process:
,
1. The Applicant Submits a Pre-Submittal Meeting Application
,The Pre-Submittal Application is mandatory. Check the Development Fee schedule for
application review fee. The submittal package must conform to the application completeness
checklist attached to this form. You are required to submit 6 copies of the submittal I,
requirements packet for pre-submittal review. Pre-submittal meetings will be conducted
every Tuesday and'Friday between 10:00 a.m. and noon. We will strive to conduct the Pre-
Submittal meeting within five to seven working days of receiving the application..'
2. Applicant and the City conduct the Pre-Submittal Meeting
We strongly encourage you, the owner and design team; to attend the Pre-Submittal
meeting. The meeting will be held with representatives from Public Works Engineering and
, Transportation, Community Services (Building), Fire Marshall's office, and the Planning
Division. The meeting will be scheduled for 30 to 60 minutes. The Planner will provide you
with a Pre-Submittal Checklist at the end of the meeting specifying the ,items required to
make the application complete-if it isn't already complete. You will then have 180 days to
make the application complete for submittal and acceptance by the City. This is the time
period when the plat and documents will be red lined by the City surveyor and the corrections.

3. Applicant Submits a Complete Application
When you have addressed all of the items on the Pre-Submittal Checklist, please submit 2
'copies of the complete application and mylars to the City. A fee will be collected at that time;
and the 120 day calendar review.period .will begin. When the Planner has completed mail ;
notification and review procedures, a decision will be mailed/faxed to the applicant/owner/ '
design team and affected parties notifying them of plat approval. The plat may then be filed
by the applicant and 5 recorded paper copies delivered to the Development Services
Depa,rtment prior to the issuance of any building permits.

This declaration is made on the date hereinafter. set forth by G & R Building Concepts. Inc..
1135 Cal Young Road, Eugene, OR 97401. Hereinafter referred to as "Declarant",
Declarant is the owner of certain real property in the City of Eugene, Lane County, Oregon, which is more
particularly described as' Lots 1 through 10, King Henry Court, as platted and recorded in File
Slide , Lane County Plat Records in Lane County, Oregon.
Declarant hereby declares that all the properties above shall be held, sold and conveyed subject to the following
easements, restrictions, covenants and conditions. Which are for the purPO:,se of enhancing and protecting the value,
desirability and attractiveness of the properties. These easements, 'covenants, c"nditions and restrictions shall run
with the real property and be binding on all parties having or acquiring any right, title, or interest in the described
properties or any part thereof, their heirs, Successors and assigns and shall insure to the benefit of, be imposed upon
and pass to the heirs, successors and assigns, and the owner or owners of any other such Lots,
Article I: 'Definitions
,
Section J: "Owner" shall mean and refer to the record owner, whether one or more persons or entities, of the fee
simple title to any Lot which is a.part ofihe Properties, including contractbuyers, but excluding those having such
interest merely as security for the performance of an obligation.
Section 2: "Properties" shall mean and refer to that certain real property described above,
Section 3: "Lot" shall mean and refer to any plot ofland shown upon any subdivision map of the properties,
Section 4: "Improved Lot" shall mean and refer to a Lot with complete living unit thereon,
Section 5: " Street" shall mean and refer to any improved public street shown ~pon the record subdivi~ion plat of
the Properties, '
Article 11,: Architectural Control
Section I: No building, fence, wall, or other structure shall be commenced, erected or maintained upon the
Properties, nor shall any exterior addition to, or change or alteration therein, be made until the plans and
specifications showing the nature, kind, shape, height, materials, color and locatio'n of the same, shall have been
submitted to and approved bylhe Architectural Control Committee, (hereafter "Committee"), Approval shall be on
by written document specifically stating that all aspects of the plans and specifications submitted a;e'approved in
their entirety or as modified, The Committee shall have sole discretion to approve or disapprove, The Initial
committee shall be the Declarant and Declarant will have full say, in all matters, until all lots are built and final
mortgage has been recorded on said lot The Primary purpose of the Committee is to create a neighborhood, which is
attractive, consistent and of high quality,
Members of the Committee shall serve until they resign or are replaced by Vote of the Committee or the Lot Owners,
A committee member may be replaced by vote of the Lot Owners representing seventy-five percent of the lots
subject to these lOonditio'1s, Covenants and Restrictions. In any such vote, each lot shall receive one vote, Lot
owners by vote, shall replace any Committee member so removed, A Committee member may be replaced by the
vote of the other members of the Committee, The remaining members shall select a replacement for a member so
removed, If a vacancy is created on the Committee due to resignations or (jiher cause, the remaining committee
members shall select a replacement

Section 2: Application for approval Each owner or builder desiring to make a site or structural improvements on
his or her lot shall, prior to requesting a building permit from the City of Springfield submit to the Committee for
approval, the following:
A: One set of plans, which shall be retained by the Committee, containing:
a, Plot plans showing location or proposed improvements on the lot
b, All elevations
c, Floor Plans of all levels
B: One set of specifications of materials descriptions list. All plans, specifications and samples will be
received by the Committee, taking the Requirements and Criteria (Article III) then in efTect, into consideration and
shall notify the owner in writing of approval and disapproval within 30 days of submission. Any notice of
disapproval shall state, with particularity, the areas of disapproval and. if practicable, corrective measures consistent
with the Requirements and Criteria,
Upon failure of the Committee to take any action on a completed application within (30) days of submission, the
application with be deemed to have been approved subject to the plans otherwise being in compliance with eth
express provisions of the Covenants, Conditions and Restrictions,
Section 3: Scope In addition to the above authority, the Committee shall also have the authority to establish rules
and approve or disapprove with respect to the various matters set forth in the following restrictions,
Article III,: Requirements aud Criteria
Upon submissiou of the plans to the Committee by an owner as set forth in Article II, approval or disapproval will
be based upon the following requirements and criteria:
Sectiou I: Height All buildings shall be one story, two story or split level and the maximum height shall be subject'
to approval by the Committee,
Section 2: Square Footage No dwelling shall be erected or maintained on any lot unless it contains at least 1800
square foot of living space exclusive of garage, open porches, patios, or breezeways or any other building structure
or floor which is other than a part of the principal residential structure, Notwithstanding anything to the contrary
herein, the square foot requirements shall be subject to approval by the Committee,
Section 3: Siding Exterior building materials shall be brick, lap, tongue and groove siding, stucco or other
architecturally comparable material. No front or side street evaluation will ,have TJ -liar equivalent.
Section 4: Roof Pilch Minimum roof pitch shall be 6/12 on all predominant roollines,
Section 5: Roof All roof material shall be shake, tile, thirty, (30) years ofTset or dark composition ("ARC-80
Style"), The Architectural Control Committee prior to installation must approve - black design,
Section 6: Exterior Colors Exterior colors shall be limited to those normally seen on traditional homes, No bright
colors are allowed! Muted colors are required to reduce visual impact as viewed for neighboring properties,
Section 7: Exterior Windows Painted, stained, clad wood or vinyl windows are preferred,
Section 8: Fencing Fences shall be built of good quality materials, including wood with treated posts, masonry.
plastic or chain link with slats, or as approved by the Committee, No fence shall protrude past the front of the
residence.

Section 9: Maintenance Dnring Construction During construction, the Lot owner shall be responsible for keeping
all streets and sidewalks in a neat and clean condition and shall not be allow any dangerous conditions left
unattended in his/her property, All materials, equipment. trailers and construction facilities shall be kept off all
streets during construction to allow cleaning and maintenance of streets.
Section 10: Waiver The Committee shall have the sole and exclusive rights in its discretion to wave, in whole or in
part, any provision, covenant, condition, restriction or reservation herein, if in its discretion, it is determined that
such action is necessary to avoid hardship to any property owner, including the undersigned and it will not
materially detract from the value of the adjoining properties, Any instrument duly acknowledged by the undersigned
and recorded in the Public Records of Lane County, Oregon, shall be conclusive evidence of such detennination and
action.
ARTICLE IV: USE AND MAINTAINENCE RESTRICTIONS
Section I: Residential Use All lots are shown on the Plat of King Henry Court shall be use only for private
residential purposes, No trade, business or professional business shall be conducted or practiced thereon, except as
allowed by the City Zoning Code governing said
Property,
Only one private, single family dwelling, not exceeding two stories in height, t"gether with the customary
outbuildings, including a private garage for not less than two (2) cars (which may be incorporated into main
residence), shall be erected or maintained on any lot. No carports shall be allowed,
All structures in said subdivision shall be constructed from entirely new materials and shall be constructed entirely
on site, Exterior walls may be ITamed and sided off site,
Sidewalks for each lot, as required by the City Springfield, shall be the responsibility of the builder or owner.
Section 2: Animals No kennel, aviary containing more than five birds, dairy, stable. barn, hutch or warren shall be
erected or maintained on any residence lot, nor shall dogs, cats, birds, horses, cows, poultry, rabbits or other animals
or fowl, be kept hereon, except this restriction shall not be construed to prohibit ordinary household pets which do
not constitute any annoyance or nuisance to the neighborhood.
Section 3: Nuisance No nocuous or effective trade or activity shall be carried on upon any lot, nor shall anything be
done thereon which may be or become an annoyance or nuisance to the neighborhood,
Section 4: Signs No signs of any kind shall be displayed to public view onany Lot except one (1) of not more than
two (2) square feet located not less' than 15 feet from the front lot line, Said sign may be used to advertise not more
than one (I) home occupation, In addition, a sign not larger than 30" by 48:; may be temporarily erected, advertising
the property for sale or rent.
Section 5: Temporary Buildings No trailer, basement. shack, tent, garage, barn or other outbuilding erected in the
subdivision, shall at any time be used as a residence, temporarily or permanently, nor shall any structure of a
temporary character be used as a residence.
Section 6: Drainage Each owner, their heirs, successors and assigns ofa lot in said subdivision agree that they will
not in any way, interfere with the established drainage over their lot and that they will make adequate provisions for
property drainage for the benefit of all affected lots, For the purpose hereof, "established drainage is defined as the
drainage which occurred at the time the overall grading of said subdivision was completed by the undersigned
Declarant" .
Section 7: Refuse No lots shall be used or maintained as a dumping ground for refuse, Trash, garbage and other
waste shall not be kept, except in sanitary containers, which shall be emptied weekly, All incinerators or other
equipment for the storage or deposal of such material as prescribed by ordinance shall be kept in a clean and sanitary

condition, During the period of construction and development of the Plat, this provision will not apply to the
Declarant. Storage of any kind of goods, chattels, merchandise. material. fuel, supplies or machinery shall be within
walls of building or enclosed by tight fences that completely screen it froni sight.
Section 8: Vehicles These covenants hereby include a restriction on overnight parking on the dedicated streets
within the subdivision, All unsightly or inoperable vehicles shall be removed from the streets and parked in
appropriate areas so as to not hinder the overall beauty of the area, All boats, trailers and recreational vehicles shall
be stored in an appropriate area behind a screen or fence no closer to the street than the front of the garage,
Section 9: Landscaping Yards shall be landscaped not more than 45 days after final inspection except when
occupancy occurs after October first and before May first. Yards delivered to occupancy during inclement weather
shall be landscaped not more than 45 days after May first. Yards shall be maintained in a near and clean condition
and grass shall be watered and cut regulady.
Section 10: Heating and Air Conditioning Exterior air conditioning or heating units orb eat pump design, shall be
approved by the Architectural Control Committee. subject to location on the lot. Window mounted air conditioners
shall be allowed,
Section II: Antennas No Antenna or Satellite dish erected on any lot shall extend more than three feet above the
portion of the roof of the dwelling on which it is mounted, Any Satellite dish shall be installed in such a way as to be
out of view from the front porch and side yards of neighbors,
Section 12: Utilities and Utility Easements

Section I: Enforcement In addition to the right of any effected Owner to enforce the covenants and restriction

ACCESS AND UTILITY EASEMENT
AND MAINTENANCE AGREEMENT
RECITALS:
A. Declarant This Declaration of Joint Use Access and Utility Easemcnt and Maintenance
Agreement is made by G & R Building Concepts, Inc. an Oregon Corporation as to an
undivided 50% interest and JLA Investments, LLC, an Oregon Limited Liability Company
as to an undivided 50% interest, the owners of the real property described as KING HENRY
ESTATES, as platted and recorded in Lanc County Official records, and the Access and Utility
Easement as described in Exhibit "A",
B, Purpose: This Declaration of Joint Use Access and Utility Eascment and Maintenance
Agreement is made to specifically providc for:
(I) Access to Lots 8, 9 AND 100fsaid KING HENRY ESTATES, and
(2) Installation and maintenance of utilities, and
(3) Maintenance requircments of the Access and Utility Easement, and
(4) Responsibilities for all persons who are or who may become parties using said easement.
WITNESSETH:
Now therefore in consideration of the foregoing recitals, which are exprcssly made a part of this
Declaration of Private Joint Use Access and Utility Easement and Maintenance Agreement, the
undersigned hereby declares as follows:
(I) Declaration of Access and Utility Easement: There is hereby declared, granted, conveyed and
created a I'~' I'~~ual and non-exclusive easement as a means of ingress and egress to and from Lots
8, 9 AND 10 of said KING HENRY ESTATES. It is furthcr declared and provided that said
easement may be utilized for the installation and maintenance of such utilities as may be needed to
serve said Parcels, It is expressly understood that no rights outside the Access and Utility Easement
are provided.
(2) Extent: The casement created by this declaration arc not personal or in gross but are
appurtenant to each said Lot.
(3) Duration of Covenants Binding or Successors and Assigns: The easement created by this
declaration shall be pennanent and perpetual and shall constitute covenants running with thc land
and shall be binding on and inurc to the bcnefit of all heirs, successors and assigns of Lots 8, 9
AND 10 of said KING HENRY ESTATES.

, (4) Exclusive: The Private Access and Utility Easement provided herein shall be exclusive to
owners, heirs, successors and assigns (and their guests) of Lots 8, 9 AND 10 of said KING
HENRY ESTATES or any portion thereof and each shall be entitled to use the Access and Utility
Easement for the vehicular, pedestrian access and utility purposes for which it is provided,
(5) Maintenance: Any property owner of Lots 8, 9 AND 10 of said KING HENRY ESTATES
may cause the Access and Utility Easement right of way or any portion thereof to be maintained or
repaired. The party causing said maintenance or repair to be done shall pay for such work, and
other property owners of Lots 8, 9 AND 10 of said KING HENRY ESTATES using the Access
Easement shall be liable for contribution based on that party's relative use proportional to the total
roadway use, This payment shall be made in a timely manner, not to exceed 30 days, from the date
of receipt of proof of expense,
(6) Taxes: Rcal property taxes shall be paid by the owners of the property upon which thc
easement is located.
(7) Indemnification: Each party shall indemnify and savc any other of the parties harmless from
any liability, loss or expenses resulting from that parties agents and employees, any independent
contractor hired by that party, and that parties permitees, invitees, licensees and guests unless that
injury is caused in part by any of the other parties' failure to contribute to the expenses of
maintenance of the Access and Utility Easement.
(8) Further Documents: In the event that any further grants or easements arc required to document
and effectuate the easement created herein for Lots 8, 9 and 10 of the aforementioned KING
HENRY ESTATES or portion thereof, Grantors each represent that caeh will execute said grants
of easements,

The site has been visited by a geotechnical engineer on several occasions to assess the feasibility of on-
site infiltration of storm water, building pad subgrades, and locations of infiltralion basins for individual
building pads. Observa!ions indicate a native silty clay subgrade, and results of infiltration testing in
Novernber 2005 showed an infiltration rate of 41 gallons/hour/square fool. It is my opinion tnat the
subject site is suitable fcr on-site infilt'atlon of storm water generated from impervious surface areas
such as the private paved accessway servicing Lots 8. 9, and 10. The intent is to shed the storm water
rU(1off from this accessway to an adjacent rock filled swale for infiltration The following discussion
provides the calculated runoff volumes and the required area to infiltrate this volumes per each section
of accessway,
The talai impervious area of the accessway is approximately 4,160 square feet. The 18-foot seeton IS
1,600 square feat, the 16-foot wide section is 1,600 square feet, and the 12,foot wide section is 96:1
square feel. The rainfall intensity curve for Zone 7 In the Jan'Jary ',990, Oregon Department of
Transportation Hydraulics Manual indicates 0.15 inches/hour of rainfall by interpolation, for a 5-year 24,
hour storm event. This value Is also consistent with Figure 4-2 of the OTAK report provided by the City
of Eugene. A 5'year 1-hour storm'event generates 0.8 inches of rainfall. The time of concentration is
less than 5 minutes,
The total generated storm water for lhe 5-year 24-hour, and 5-year 1-hour events is 9,335 gallof1s. and
2,074 gallons, respectively, For individual sections of the accessway the storm water volumes are 3,590
(24 hour event) and 798 (1 hour event) gallons for the 1,600 square for sections, 2nd 2,154 (24 hour
event) and 479 (1 hour event) 9allons (or Ihe 960 square fool sections. The slorege volume of Ihe drain
rock filled basin has generally been measured 10 be 35% of the total volume but the sto'age volume is
not ConSidered in the calculation Of required infiltration area.
