There is an intake screening process and a detailed completeness check:
I. An intake screening process will be conducted at the front counter at the time of submittal. Planning Division
. staff will determine whether all required items listed in the Annexation Submittal Requirements Checklist have
been submitted. An application for submittal not having all of the required items will not be accepted.
2. A deiailed completeness check will be conducted within 30 days of submittal. In this case, the assigned Planner
will notifY the applicant in writing conceming the completeness' of the application. An application will not be
deemed technically complete until all information necessary to evaluate the proposed development, its impacts and
its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes
ha~e been provided.
, Incomplete applications will delay the application review process and may result in denial if information pertaining to the criteria
of approval is deficient or missing.' .

EXPEDITEDPIWCEDURE .~lifHORIZED BY LAW. ORS 199.466 authorizes approval of a[,
annexation proposal or a city or district exrniterritorial water or wastewater line extension proposal without
the necessity of the boundary commis'sion's conducting a formal srudy or public hearing on the proposal or
adopting a final order. The specific language which authoriz.es this procedure is reproduced on the back of
this page. It should be noted that this procedure was enacted for r.outine, noncontroversial proposals. . A
request for use of this procedure might actually take more time since a public hearing and study can be

conditions; appeal. (1) \Vhen filing an annexation petition or application under ORS 199.464 '(3) or (4) with
a boundary commission, the principal petitioner may request that the petition or application be approved
, without the study, public hearing and adoption of a final order required under ORSI99.461. If such request
is made, the executive ,officer of the commission, not later than the 15th day after the filing of the petition or
application, shall prepare a brief analysis of the petition or application and a recommendation for disposition:
of the proceeding, and send a copy of the, analysis and recOn'lmendation to each comri1ission member, to the
governing body oreach city, county and district with territory affected by the annexation oTextension, to the
owners of the affected territory and to such other persons as may be required by the 'commission. If the
executive officer fails to prepare the analysis and recommendation by the 15'h day' after the filing of the
petition or application, then the petition or application shall be approved only after the study, public hearing
and adoption 'of the final order required under ORS 199.461.
(2) If, within 25 days after the filing of an annexation petition or application for an extraterritorial
water or sewer line extension, a person or governing body that received a copy of the executive .officer's
, analysis and recommendation under subsection (I) of this section does not ask in writing for a public hearing
on the proceeding under ORS199.46 l, the petition or application shall be considered approved by the
cOlmnission. After such approval; the executive officer of the commission shall send written notification of,
the approval to the officials and person~;"described in ORS 199.461 (5) or (6). For an annexation petition, the'
, notification shall contain a legal description and map describing the territory approved for annexation, and
. for an application under ORS 199.464 (3)01' (4), a g~neral descnption and map of the temtory affected by'
the exterslon. If a request for a public hearing is received by the commission within the 25-day period after
the filing, the commission shall proceed as provided by ORS '199.460 to 199.463 and 199.490 to 199.534.

Optional Expedited Procedure for Annexations
Please'read the attached instructions and fill out the attached form if you wish to apply
for the expedited procedure through the Boundary Commission. The expedited
procedure is a Boundary Commission procedure and it does not change the timing of the
City ofSpringfieJd's review. However, it may Jessen the approval time before the.
Boundary Commission.
This procedure is for routine, non-controversial annexations. Please be aware that an
expedited request may actually take longer than a non-expedited annexation if a public
hearing is called for by a boundary commission member or other authorized person. See'
, page 2 of the attached instructions for more information on this. '

A. RONALD D. GALCERAN and KAREN L; GALCERAN, Husband and
Wife (hereinafter' "GALCERAN") is the Owner of real property
("Parcel I") located in Lane County, Oregon, upon which a well,
pump, pump shed, pumping equipment and, pipelines are located
(hereinafter "well") that is used exclusively by the real property'
adj acent to Parcel I (which adj acent property is hereinafter'
"Parcel II") Said Parcel II is owned by .THOMAS W. HEATH and
WESTLEIGH C. HEATH (hereinafter collectively "HEATH").

B. GALCERAN desires to convey to HEATH, an exclusive
Easement to use the well and pipelines. Parcel I,and Parcel II
are described more fully on attached EXHIBIT A, incorporated herein
fully by this reference.

The consideration for this Easement is part of the

1. Well Agreement. GALCERAN as Owner of Parcel I hereby
grants and conveys to HEATH, as Owner of Parcel II, a perpetual,
exclusive easement to access and use the existing well located on
Parcel I and draw water therefrom for t:he use and benefit of
Parcel II.
1.1 This easement is not personal and it is not in gross, but
it is to be, appurtenant to that real property described as
Parcel II.
1.2 This grant is made 'upon the foll"owing terms:
a. It is unders~ood that the o~ner Df Parcel, II's right to
use and access the well shall includ~ the right to come upon
Parcel I property for maintenance of the well, pump shed,
holding tank, and pump and for the in'stallation and mainten-
ance of the pipeline and such public utilities as may be
needed to serve the well. The access to the pipeline shall
extend five ,( 5') feet on ei ther side of the pipeline. The
access to the pump shed shall extend to a reasonable distance
around the pump shed necessary to accomplish the repair,
maintenance or replacement.
b. In .the event the well ceases to' provide adequate water
for any reason, the following shall apply: At the Dption of
the ,then Owner of Parcel II, Owner's successors or assigns,
the parties may replace the well, pump, pumping equipment and
or pipelines at the Owner of Darcel II(s sole cost and expense
and extendi'ng this Agreement;
c.. Should, any of the owners of' Parcel I I desire to
disconnect from the well and pump system on a permanent basis,
then and in that event, all easement rights contained herein
for pipelines and, use of the well, pump and equipment shall
cease and be extinguished forever to such Parcel I. There-
after, the well and pump shall be the sole property of the
owner of Parcel I. '
2. Maintenance Costs. The Owner of 'Parcel 1'1 shall pay all
the cost of maintaining the well, pump shed', holding tank, pumping
equipment, and pipelines.

3. Enforcement of Terms. In the event suit or aceion is
taken to, enforce any of the terms of this Agreement, the prevailing
party in such suit or action shall be entitled to such sum as the
court shall deem reasonable as attorney fees; and in the event that
an appeal is taken from the' decision of the trial court',- such
further sum as may be fixed by the appelrate court as reasonable
attorney fees. If either party is in default under the terms of
this Agreement, and the other party delivers this Agreement to an
attorney for the purpose of remedying the default, and whether or
not any suit, action or other proceeding is filed, the defaulting
party shall pay the reasonable fees of the attorney to whom this
Agreement was delivered.
Before involving an attorney to address any perceived default
or breach of this Agreement, notice shall be given in writing
specifying the perceived default or breach and allowing the
parties ten (10) days time within which to attempt to meaningfully
negotiate and fully resolv~ the potential dispute. Notice shall be
deemed given by sending a letter in first class mail appropriately
addressed to a party.
