Recommendation to Withdraw Aoplication
The applicant was advised by staff that incomplete information was provided for his
proposed partition at the northwest corne~'of Garden and Laurel Avenues. Numerous
items cited by Public Works Engineering, Transportation Planning and Urban Planning
. were discussed jn a brief meeting with t~e applicant on June 15. The applicant was
informed that he could either withdraw the application or have a denial issued for the
application. Additionally, the applicant was advised that an extra-territorial extension of
water line could not be approved by the City based on current Code language - see
SDC 29.070(1)(a).
Staff recommended that the applicant-withdraw the request for extraterritorial extension
and request a refund, and withdraw the partition application and request a refund. The
applicant was advised that a full refund should be forthcoming for the extraterritorial
extension but only a partial refund for the partition: Staff advised the request to
, withdraw the applications should be made in writing and submitted within 5 business
days.' '
Staff provided information to the applicant on 'the application fees to change the clause
in the Development Code, including application for Development Code Text.
Amendment ,and Formal Interpretation Involving Policy. Finally, staff suggested the
applicant could express his views to Council at an open forum.
