HomeMy WebLinkAboutCorrespondence PLANNER 7/21/2006 Duane Knights' 2258 33rd Street Springfield, OR 97477 225 FIFTH STREET SPR/NGFIELD, OR 97477 (541) 726-3753 FAX (541) 726-3689 www.ci.spring/ie/d.or.us July 21, 2006 Dear Mr. Knights: Further to our previous discussions regarding your request for extraterritorial waterline extension (Planning Case: LRP2006-00018) and proposed 3-lot partition (SUB2006-00033), I can advise as follows: Planning staff recommended withdrawal of these applications due to specific' language within the Springfield Development Code (SDC) pertaining to extraterritorial utility line extensions. In accordance with SDC 29.070( I)(a), "The City shall not' extend water or sanitary sewer service outside the city limits, unless the property owner. obtains annexation approval from the LCLGBC [Lane County Local' Government Boundary Commission]". Planning staff requested clarification from the LCLGBC as to what constitutes "annexation approval"; and this was confirmed as full annexation to the City of Springfield (as opposed to a "consent to annex" or "amlexation agreement"). Furthermore, annexation will not be granted by the LCLGBC in the absence of available City sanitary sewer facilities to serve the development area, the nearest of which are currently located in Jasper Road approximately 1000 feet north of your property. Following our discussions with you on this matter, it was a reasonable determination of Planning staff that you would not be prepared to undertake a major Public Improvement Project to install at least 1000 feet of sanitary sewer line (and possibly additional related infrastructure such as a pump station) within Laurel A venue to facilitate a 3 lot partition. For the reasons stated above, Planning staff recommended .that you withdraw the request for extraterritorial waterline extension as it could not be approved by City Council. Denial of the . request by City Council would have resulted in forfeiture of the application fees. Similarly, Planning could not approve the tentative partition plan in the proposed configuration because . water .and sewer were not available to serve the lots. If the application had not been withdrawn, the City would have issued a denial resulting in' forfeiture of all application fees. Just as important, it would also prevent a similar application from being filed for the same property for a period of one full year. .
