2006, with the Lane COUnIy Local Government Boundary Commission in accordance
with ORS 199,466 and ORS 199,490(2)(a)(B). .
2. An analysis was prepared by the boundary commission slaffwith a recommendation of
approval and was sent on January 2, 2007, to the Lane boundary commission members;
Lane CoUnty commissioners; Lane Counly Land Management" Division; Lane County
Environmental Health Division; City of Springfield; Willakenzie Rural Fire Protection.
District;Willamalane Park arid Recreation District; Ted and Jeannine Crane; and Chris
Nash at Poage Engineering. .
3. No requesl for public hearing was received by 5:00 p.m., January 9, 2007.
4. This annexalionproposal, described in attached Exhibit A and shown on attached map
Exhibit B, is hereby approved and effective January 9, 2007 (ORS 199.466 and ORS
199.519).

NOTE: The annexation area is within the Willakenzie. Rural Fire Protection District and will
automatically be withdrawn in accordance with ORS 199.51O(2)(a).
In accordance with. ORS 199.S10(2)(c): the annexation area is. hereby part of the Lane County

This annexation proposal was filed with the boundary commission on December 15, 2006, in
accordance with ORS 199,490(2)(a)(B), initiated by the City of Springfield with the consents
from the property owners and electors. Prior to initiating the annexation, the City of Springfield
received written consent to the annexation from the property owners (Ted and Jeannine Crane)
and a majority of the eligible electors. At the time the annexation was initiated by thb. city

199.466 ( expedited procedure) be used in processing ~s annexation request.

ORS 199.466 authorizes ~pproval of annexations without a public hearing or adoption of a final
order if requested by the principal .petitioner. Undq-the expedited procedure, the boundary
commission executive officer. must prepare an analysis of the proposal within 15 days from its
receipt. If, after 25 days from the filing date (in this c~se, January 9th), no written objections are
received from direct recipients of this staff analysis, tpe request is approved. However, if any
direct recipient of this staff analysis does object, . the proposal is scheduled for the next regular
boundary commission public hearing. The direct recipients of this staff analysis are 'the
individuals eligible to request a public hearing and <ire listed below under the first boundary
commission standard. I.
. The proposed annexation involves one tax lot (refer tolMaps No.1 and 2) kId is developed with
one single-family residence occupied. The annexation area is within the Eugene-Springfield
Metropolitan Area G~eral Plan (Metro Plan) urban drowth boundary (U'GB), which is located
about 900 feet to the south. The annexation area is zoned LDR/UF-IO, low-density residential
with urbanizing fringe overlay, in Lane County. Upoh the effective date of the annexation, the
UF overlay,will lapse and the annexation area will be zoned LDR in Springfield.

Resolution No. 06-39, unanimously approved by the Springfield city council on September 18,

2006, indicated that the annexation area can be provided with key urban services and requested
that the resolution be forwarded to the boundary commission.

This annexation request was filed in accordance with provisions in ORS 199 and was determined

commission filing requirements). The petitioners req4ested the proposal be processed u,sing the

Upon the annexation effective' date, the area wilI be annexed automatically to the Lane County
Metropolitan Water Service District and the Willamalane Park and Recreation District [ORS
199.510(2)(c)] because the city is a part of both these special districts. The Lane County
Metropolitan Wastewater Service District was formed to provide the financing for the reliional
wastewater treatment plan serving wastewater users within the cities of Eugene and Springfield.
This request is consistent with this standar~1.

Make boundary commission determinations which are consistent with acknowledged local
comprehensive plans. Assure an adequate quality and quantity of public services required in
the comprehensive plan to meet existing and future growth. For major boundary changes,
there must be assurance that the proposed unit oj government is financially viable. ORS

The Eugene-Springfield Metropolitan Area General Plan is the applicable comprehensive plan
and was acknowledged by the Land Conservation and Development Commission (LCDC) in
August 1982 and has been subsequently amended. Th:e Metro Plan recognizes annexation as the
highest priority for extending the minimum range of~rban services to urbanlzable areas (policy
#8 and policy #10, page ll-C-4) and recognizes that' ultimately, all territory within the urban
growth boundary will be annexed to an existing city (p~licy #] 6, page ll-C-5). . .

fire district in accordance with ORS ]99.510(2)(a). After annexation, the City of Springfield will

Parks and Recreation -The annexation area is not within the Willamalane Park and Recreation
District and will automatically annex t? the district upon ~exation to the city. The city of
Springfield is part of the park district and city residents receive park and recreation serVices;,from
the district. The district operates two aquatic centers, a community center, an adult activity
center, and 3 I parks containing a variety of outdoor recreational amenities. The closest pa{ks to

annexation area from the 24-inch line located in S 42nd Street. The public system has adequate
capacity to accommodate existing and new development within the annexation area. '
Streets - Springfield staff indicates that S 42nd Street is annexed to the city and was impro~ed to
full city standards during City Street Project P20347 last summer. The annexation afea is
adjacent to S 42nd Street. New street development and access issues will be addressed duiing a
future development process. "
Solid waste management - Private firms and individuals collect and transport solid waste to the
Lane County administered landfilL
Community facilities.- Various providers offer both wire and wireless communication s~ces
in the Eugene-Springfield metropolitan area.
Land use controls - The property is within Springfield's portion of the Eugene-Springfield
metropolilan urban growth boundary. Through an intergoverrunental agreement between :'Lane
County, the city already has planning and building jurisdiction for this property. The citY will
continue to administer land use controls after annexation.

A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRiTORY TO THE CITY OF
SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT
BOUNDARY COMMISSION APPROVE THE ANNEXATION BY EXPEDITED PROCESS
WHEREAS, the Co=on Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation
upon receiving consent in writing from a majority of the electors registered in the territory proposed
to be annexed and written consent from owners of more than half the land in the territory proposed
to be annexed; and,
WHEREAS, one hundred percent of the property owners of the territory signed the consent to annex
petition (Exhibit 1); and,
WHEREAS, one hundred percent of the registered voters within the territory signed the attached
consent to annex petition; and,
WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary
and can be provided with UIban services.
NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS:
~ection 1: The Co=on Council of the City of Springfield does hereby reco=end approval of the
expedited annexation of the. subject territory to the City by .the Lime County Local Go"emment
Boundary Commission, Lane County, Oregon, said territoi)' being described as follows:
Township 17 South, Range 2West, Section 05, Map 21, Tax Lot 8700, more particularly
described ill Exflibit 2 of this Resolution.
~ection 2: The Council furth~ requests that the Lane County Local Government Boundary
Commission approve the proposed annexation authorized by ORS 199.466 without the study, .
public hearing and adoption ofa final order required by ORS 199.461. .
$ection 3; This Resolution shall take effect upon approval by the Council and approval by the Mayor.
