Steps in the Process:
1. The Applicant Submits a Pre-Submittal Meeting Application
The Pre-Submittal Application is mandatory but there is no additional review fee for this
service. The submittal package must conform to the application completenesSllchecklist
attached to this form. You are required to submit 7 copies of the submittal requirements
packet for pre'submittal review, Pre-submittal meetings will be conducted every Tuesday
and Friday between 10:00 am and noon. We will strive to conduct the Pre-Submittal meeting
, within five to seven working days of receiving the application. " .
2. Applicant and the City conduct the Pre-Submittal Meeting
We strongly encourage you, the owner and design team to attend the pre-subt'hittal meeting.
The meeting will be held with representatives from Public Works Engineering a~d
Transportation, Community Services (Building), Fire Marshall's office, and the ~Ianning
Division. The meeting will be scheduled for 30 to 60 minutes. The Planner willi! provide you
with a Pre-Submittal Checklist at the end of the meeting specifying the items required to
make the application complete-if it isn't already complete. You will then have 180 days to
make the application complete for submittal and acceptance by the, City. . ,
3. Applicant Submits a Complete Application
When you have addressed all of the items on the Pre-Submittal Checklist, pleas.e submit 18
copies of the complete application to the City. A fee will be collected at that tini'e and the 120
day calendar review period will begin. When the Planner has prepared a draft limd use
decision, the draft will be mailed/faxed to the applicant/owner/design team for their review.
At the applicant's request, the planner will schedule a meeting to review the dr~ft with .
appropriate staff if certain issues need resolution before the final land use decision is issued.

DECLARATION OF EASEMENT:
1. EASEMENT CREATED. OWNERS hereby create a perpetual, nonexclusiye private
roadway easement to serve Lots 2 and 3, and any future diyision thereof oyer the area
. shown in Exlubit "A". .
2. EASEMENT PROVISION. The terms of this easement are as follows:
2.1. PURPOSE. The easement is for access and maintenance of the, roadway and utilities .
serving Lots 2 and 3 of King Henry's Court Subdivision per Document
No. and any future division thereof.
2.2. USE OF BURDENED PROPERTY. The owner or occupiers of Lots 2 and 3 of
King Heriry's Court per Document No. and of any future
diyision thereof shall haye the right to use their property, including the area described in
the easement, for any purpose so long as the owner or occupiers do not ink,:"... with the
use of the easement of access as granted by this instrument.
No building, shrub, tree or other physical impediment shall be placed within the
Easement area by any person in such.a manner as to preclude its use as a conunon access
and maintenance area for Lots 2 and 3 per Document No. and any
future division thereof.
2.3 PRIVATE GRANT. The easement created by this instrument does not constitute a
dedication or grant for public use.
2.4 MAINTENANCE AND REPAIRS. The cost of normal maintenance or repair of the
property within the easement area shall be apportioned equalIy betWeen the owner or
occupiers of Lots 2 and 3 of King Henry's Court per Document No.
and any future division thereof. The cost for exCeptional or unusual maintenance or repair

occasioned solely by the actions of the owner or occupier(s) of one parcel or any future
divisions thereof only shall be home exclusively by the owner or occupier(s)
necessitating the repair or maintenance.
3. ENFORCEMENT. If any suit, action, or other proceeding or appeal therefrom, is .
instituted to enforce, compel, or clarifY any right or obligation created in this instnHnent,
the preyailing party shall be entitled to receive from the adyerse party, in addition to costs
and disbursement, an award of reasonable attorney fees to be set by the trial,or appellate
court.
4. SUCCESSORS IN INTEREST, RECORDATION. The provisions of this
instrument touch and concern, and relate to the. use of Lots 2 and 3 of King Henry's Court
per Document No. and any future division thereof and are
