RESOLUTION NO. 96-51 A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CllY OF SPRINGFIELD AND REQUESTING THAT THE lANE COUNTY LOCAL GOVERNMENT BOUNDARY COVIMISSION DELAY THE EFFECTIVE DATE TO JANUARY 4, 1999. WiEREftS, the City Council is authorized by ORS 199.490(2)(8) to initiate annexation upon receiving consent in \Miting from a majority of the electors registered in the territory proposed to be annexed and \Mitten consent from ovvners of more than half the land in the territory proposed to be annexed (Attachment 1), and WiEREAS, sanitary seHer service can be provided in timely manner via extension to the lot from the sewer line along the south of the property and water service can be provided by the Rainbow Water District, and WiEREftS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary, and can be provided il1VTlediately with a full range of urban services induding fire protection via contract with the Rainbow Water District, and and police services via contract with the City of Springfield, and WiEREftS, a delay of the annexation effective date to January 4, 1999 will ensure that the improved value of the property is captured in the tax base of the City, and WiEREAS, O"egon Revised Statute 222.180 allows the City to specify an effective date that shall not be later than 10 years after the date of proclamation of annexation. NON THEREFORE THE CllY OF SPRINGFIELD DOES RESOLVE PS FOLLOJ\G: Section 1: The Cornron Council of the City of Springfield does hereby recomend approval of the annexation of the subject territory to the City by the lane County Local Government Boundary Corrrrission, lane County, O"egon, said territory being described as follows: Township 17 South, Range 3 V\est, Section 33, Map 11, Tax Lot 800; as more particularly described in Attachment 2 of this Resolution. Section 2: The Council further requests that the lane County Local Government Boundary Commission delay the effective date of the annexation until January 4, 1999.' November 13, 1996 Project No. 96-14B EXHIBIT "A" LEGAL DESCRIPTION FOR GRAY ANNEXATION TO THE CITY OF SPRINGFIELD Beginning at a point marking the initial point of DEVONSHIRE PARK, as platted and recorded in Book 59, Page 5, Lane County Oregon Plat Records, said point being 3376.56 feet South 020 32' West and 18.0 feet North 8r 11' 45" West from the Northwest corner of the Robert Campbell Donation Land Claim No. 59, Township 17 South, Range 3 West of the Willamette Meridian, in Lane County, Oregon; running thence South 8r 11' 45" East 32.0 feet to the West line of Anderson Lane; thence North along the West line of Anderson Lane, 303.09 feet to a 5/8 inch iron bar marking an angle corner of that certain tract of land as described in contract recorded November 1, 1966, Recorder's Reception No. 65413, Deed Records of Lane County, Oregon, and the True Point of Beginning; running thence North 850 02' West 222.0 feet to a 5/8 inch iron bar; thence North 020 30' East 136.0 feet to a 5/8 inch iron bar; thence South 850 08' East 222.0 feet to a 5/8 inch iron bar set on the West line of said Anderson Lane; thence South along the West line of said Anderson Lane, 136.0 feet to the True Point of Beginning, in Lane County, Oregon.
