CITY OF SPRINGFIELD, OREGON RESOLUTION NO. 98-12 A RESOLUTION AUTHORIZING THE INSTALLATION OF A SEPTIC SYSTEM WITHIN THE CITY OF SPRINGFIELD, TAX LOT #17033534-06900 WHEREAS, the City Code prohibits installation of new septic systems within the City of Springfield city limits, except as provided in Section 4.308 ofthe Code wherein the Council reserves the right, at its discretion to allow such installation where special conditions or considerations exist and where the public interest is best served; and WHEREAS, the owner of Tax Lot #17033534-06900, which is located within the Springfield city limits, desires to place a single family residence on that tax lot and has requested permission from the Council to construct a septic system to serve that residence; and WHEREAS, the Public Works Engineering staff have reviewed the circumstances of this request for septic system installation and have concluded that this lot, and the surrounding two or three lots adjacent to this lot, do not have a reasonable option for gravity public sewer service because of the isolated location and contour of surrounding topography, and would need to install a pump station for such service, and staff do not recommend that such a system be installed because of costs of maintenance of the system and the unstable ground area that the discharge from such a system would go through; and WHEREAS, the Lane County Sanitarian has determined that this lot has adequate size and soil characteristics for safe installation of a septic system and replacement drain field, as required to meet Lane County standards and has drafted a permit which is on hold pending Council approval; and WHEREAS, the Council's permission to install a septic system for this lot does not in any way grant permission,for the building to go forward until all other requirements for the granting of a building permit for this lot are met, including but not limited to all City Code, Development Code and conditions or requirements of the building permit are met; and WHEREAS, permission to install a septic system does not preclude a future City requirement to participate in paying for a portion of the costs of and hooking to a public sewer system, should conditions change and such a system be available in the future; and WHEREAS, action on this permission for a septic system installation should be taken within a reasonable time frame so as not to bind future staff or Councils should conditions change in the future; NOW THEREFORE BE IT RESOLVED, by the Common Council of the City of Springfield that: Tax Lot #17033534-06900 is permitted to install a septic system for service to a single family residence on that lot provided that all other City requirements for the construction of the residence are met and provided that the installation takes place within five years of the approval ofthis resolution. Adopted by the Common Council and approved by the Mayor of the City of Springfield, Oregon this 9thday of March, 1998. Adopted by a vote of ~ for and ~ against.
