ofChroineWorld's facility has b~en recognized as you point ouLA facilityofthis quality is highly regarded
in our community and we look forward, to working with Mr. Sprainis in the future, Our responses to the
issues you develqped in your letter are listed below, We will continue to work with you to provide

Impact'on existing operations:
As written, Article 17 will have no imnact on the current operations of the chrome plating business. Chrome
, World does not have to be dismantled and your business can continue as it is, We believe this has been
clarified in, staff discussions with the owner and yourself during our meetil1g at City Ha.ll on March 6, You
, ' had suggested at that meeting that you would present specific questions for our response in order to provide
the, assurance for Mr, Sprain is and prospective buyers., When these questions are developed, we would be
happy to provide written responses and to meet and discuss the issues further. '
Expanded future operations:
, Chrome World is located on a large lot that is primarily within the 1-5 TOTZ, Article 17, as it is drafted,
provides an Excepiion in 17.040.(3)( c) which provides an option for a business to' expand its operations on
the existing property. Theref6re, future plans that include expansion of your use of hazardous materials
within the framework of Article 17 can be accomplished with new chemical storage located on the
undeveloped part of the lot easfor south of the existing building. As We discussed in the meeting, any
expansion of your business that does not indude hazardous materials, such as the springs you showed us,
is not covered by Article.!7.' '
, Exemption from qnantity limits for hazardous materials offered for sale in containers 0(5 gal. or less:
,'This exemption was not derived from articles in the fire code. The Citizen Task force discussed this issue
at length prior to recommending the exemption. They reviewed the ordinances in other communities with
similar Wellhead mid Aquifer Protection Areas and heard directly from representatives from Renton,
Washington, All of the other communities have similar exemptions and the reason given for implementing
them was that they believed there was less risk, Their programs, like Springfield's, include extensive
education programs and technical outreach." '
Request for Grandfathering:
Staff is unsure what you are asking for in this request. Your exisiing business and uses are not affected by
Article 17, as noted in the first paragraph above, However, the Citizen Task Force was explicit that the

Overlay District standards would apply toexisting business that 'want new uses of hazardous materials. A
business must submit an application a) when there is a change of use, occupancy or tenancy of a property,
b)'during the Building Permit process, c) when there is an internal alteration ofa building that does not
require a Building Permit, or d) in conjunction with any development application and affecting the storage,
use, handling, treatmel}t, production, and/or transportation of hazardous materials (17.050(1)), If an
application is not required, then existing businesses' can expand the use of hazardous materials or increase
production without coming und~r Article 17 regulations, The "Drinking Water p~otection Plan" prepared
by the Citizen Task Force, adopted by the City of Springfield, and certified by the Oregon Health
Department, and Oregon Department of Environmental Quality was used as the basis for Article 17.'
