MINUTES OF THE CONTINUED REGULAR MEETING OF AUGUST 19, 1996 THE SPRINGFIELD CITY COUNCIL HELD MONDAY, AUGUST 26,1996 The City of Springfield Council met in Continued Regular Session in the Jesse Maine Room, 225 Fifth Street, Springfield, Oregon, on Monday, August 26, 1996 at 7:58 p.m., with Mayor Morrisette presiding. ATTENDANCE Present were Mayor Morrisette, Councilors Ballew, Beyer, Burge, Dahlquist, Maine and Shaver. Also present were City Manager Michael Kelly, Assistant City Manager Gino Grimaldi, City Attorney Tim Harold, City Recorder Eileen Stein, Administrative Aide Julie Wilson and members of the staff. PUBLIC HEARINGS 1. Continued Public Hearing for Project 1-995, Paving, Curbs, and Gutters, Sidewalks, Street Lighting, Street Trees, and Storm Drainage to Serve South 41 st Street From Main Street to 220 Feet South, and Vicinity. . ORDINANCE NO.1 - AN ORDINANCE ADOPTING THE REPORT OF THE CITY ENGINEER FOR THE INST ALLA nON OF PAVING. CURBS AND GUTTERS. SIDEWALKS. STREET TREES, STREET LIGHTING AND STORM DRAINAGE TO SERVE SOUTH 41 ST STREET FROM MAIN STREET TO 220 FEET SOUTH AND VICINITY (1-995. ALTERNATE A) AND DECLARING AN EMERGENCY. City Manager Mike Kelly introduced this item. At the August 19 Council meeting, Council decided not to consider the Alternate B project and table for one week action on the public hearing for the Alternate A project (the shorter project) in hopes that the owners, Miles Investments and Tentinger, can come to a cost sharing agreement. If no agreement is reached, the Council may consider two options: 1) move forward with Alternate A project, or 2) take no action thereby canceling the project. Mr. Kelly reported that Miles and Tentinger have reached a tentative cost sharing agreement and that Miles is requesting a one week continuance to determine whether Tentinger can obtain private financing for his portion of the cost. Mr. Kelly recommended this item be continued for one week. Councilor Burge commented that if the full street improvement work was not completed, a large gap would be left until such time that property is redeveloped. He discussed the cost to maintain unimproved streets and asked what obligation the City of Springfield has to maintain substandard streets. Mr. Kelly replied that the City does try to keep gravel streets safe and driveable. He explained that as long as property owners pay the cost of gravel, the City of Springfield will maintain the gravel street by smoothing it out. Mr. Kelly discussed the City's obligation to maintain fully improved streets. . Mr. Kelly discussed the cost of assessments for improving streets. He referenced this particular project and stated the bids came in much higher than expected. He understood that people did not like the cost of improving streets. He stated that when a 40 apartment property City of Springfield Regular Council Meeting Page 2 . owner stood up and denied their was a need for improvement, he felt the owner was really stating that they wanted to avoid the associated improvement costs. He stated that if the development occurs, the area between property owned by Tentinger and Miles may never be improved (completed). He felt the City of Springfield had a responsibility to enforce its regulations, even though they may result in a burden to property owners. Councilor Burge asked whether the project included a storm drainage pipe. Supervising Civil Engineer Don Branch replied it does and was needed to alleviate storm drainage problems on the street. IT WAS MOVED BY COUNCILOR SHAVER, WITH A SECOND BY COUNCILOR MAINE, TO GRANT A CONTINUANCE UNTIL SEPTEMBER 3, 1996. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Correspondence from Carla McQuillan, Children's Choice, 5005 Main Street, regarding System Development Charges for her Child Care Center. City Recorder Eileen Stein provided a missing page from the McQuillan correspondence which was left out of the copy provided to Council. IT WAS MOVED BY COUNCILOR BURGE, WITH A SECOND BY COUNCILOR MAINE, TO ACCEPT AND FILE J:HE CORRESPONDENCE NUMBERS 1,2 AND 3. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. BIDS 1. Bid award for Project 1-995; Street Improvements for South 41 st Street, From Main Street to the South, and Vicinity. This item was continued to September 3, 1996.
