AND MAINTENANCE AGREEMENT
The true and actual consideration for this conveyance is

RECITALS:
1) THOMAS F, MCGINNIS, Grantor, is the owner ofthe lands that were conveyed in that
certain Warranty Deed that was recorded October 14, 2003 at Recorder's Number 2003-
100369 in the Official Records of Lane Co'unty, State of Oregon, (Tax Map 17-03-36-13,
Tax Lot 13901 at tinie offecordation of this document), ,
2) DAVID LARSON, G'rantee, is the owner of the lands'that were conveyed in that certain'
Bargain and Sale Deed that was recorded September 29, 2006 ai Recorder's Number 2006-
071481 in the Official Records of Lane County, SUite ofOn;gon, (Tax Map 17-03-36-13,'
Tax Lot 13902 at time ofrecordation of this document),
3) The Grantee desires to acquire an easementJor transference of sanitary waste water from his
lands across the lands of the Grantor to the public sanitary waste water system,
THEREFORE:
THOMAS F. MCGINNIS, Grantor, hereby grants; transfers and conveys to DA VlD LARSON,
Grantee, anon-exclusive, perpetual, appurtenant easement for sanitary waste water conveyance
,under the north 8,00 feet, by, perpendicular measurenient. of said lands of the grantor. The use of
said easement shall be subject to the following: '
1) The Grantee herein shall contribute to the costs' and maintenance of the private sanitary
waste water facilities in a proportionate amount that is equal to one over the total number
, of benefited parcels, ' ,
2) The easement is not personal or in gross, but is appurtenant to each and every portion of
the lands of the Grantee,
3) Grantor shall at all times, and without restriction, have the right to use the easement area
for purposes not inconsistent with the purpose of the easement.
4) Said easement shall run with the properties herein described and shall be binding on and
inure to the benefit ofthe parties hereto, their heirs, ,successors or assigns,
