HomeMy WebLinkAbout11/17/1997 Work Session . . . , ~ MINUTES OF THE WORK SESSION MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, NOVEMBER 17,1997 The city of Springfield council met in work session in the Jesse Maine Room, 225 Fifth Street, Springfield, Oregon, on Monday, November 17, 1997, at 6:05 p.m., with Mayor Morrisette presiding. ATTENDANCE Present were Mayor Morrisette and Councilors Beyer, Burge, Dahlquist, Maine and Shaver. Councilor Ballew was absent (excused). Also present were City Manager Michael Kelly, Assistant City Manager Gino Grimaldi, City Attorney Joe Leahy, Senior Management Analyst Rosie Pryor, City Recorder Julie Wilson and members of the staff. 1. Proposed Code Amendments Concerning the Regulation of Home Occupations, the Jurisdiction of the Hearings Official and Planning Commission, Mailed Notice, and Minimum Development Standards. Planning Manager Greg Mott presented the staff report on this issue. These amendments, if adopted, would eliminate permitting requirements for Home Occupations; replace the Hearings Official with the Planning Commission in the urban transition area; eliminate Minimum Development Standards (MDS); and reduce the radius of mailed notice from 300 feet to 100 feet. Council discussed these amendments at budget meetings during the Winter and Spring of this year. Council agreed in principal to these amendments during the April 28, 1997 work session. Based on direction received at that meeting, the Planning Commission conducted several work sessions and public hearings on these amendments with the purpose of forwarding a recommendation to council. On November 4, 1997, the Planning Commission recommended approval of: changes regulating Home Occupations; transferring land use authority in the urban transition area to the Planning Commission; and reduction of mailed notice. The Planning Commission scheduled a hearing to consider changes to MDS on December 2, 1997. The proposed language for this amendment was finalized during the November 4, 1997 work session. Mr. Mott further reviewed effects resulting from the reduction of the Code Enforcement Officer and the secretarial position in the Community Services Division. He discussed annual licensing and Home Occupations. He also reviewed replacing the Hearings Official with the Planning Commission in the urban transition area. He discussed the current intergovernmental agreement with Lane County. Minimum Development Standards (MDS) were also discussed. Mr. Mott discussed financial constraints and instances in which a Hearings Official was required. Councilor Shaver discussed a delayed effective date. Mr. Mott discussed rules related to charging fees. He said this could be revisited in July if so desired. Councilor Shaver discussed the reduction of the radius of mailed notices from 300 feet to 100 feet. Mr. Leahy said that every hearing he has been involved with starts out with the question of whether appropriate notice was given. He said the reduction would not shorten the land use process. . . . _.~ Work Session Meeting Minutes November 17,1997 Page 2 Mr. Mott said an average of 70 - 150 notices are sent out. He said 60 to 130 notices are usually deliverable. Councilor Maine asked if staff could apply MDS to specific areas. Mr. Mott discussed specific standards and districts. He discussed other jurisdiction regulations and the site plan review process. Mr. Mott also discussed downtown standards. Councilor Burge liked the idea of an annual licensing for Home Occupations. He discussed MDS and had concerns regarding the word "minimum" and said it seemed to be the target. He also discussed change of use/tenant and what is best to the overall good of the community. Mr. Mott said the Lane County Boundary Commission staff did post notices when appropriate. Mr. Mott discussed the cost to retain MDS and Home Occupations, along with a 300 foot radius for mailed notices. Councilor Maine suggested a mid-year budget review be conducted prior to making changes. Councilor Beyer said there were limits given to the Development Services Department and what needed to be considered. It was agreed to delay the decision pending discussion. Mr. Mott said he would provide council with a recommendation from the Planning Commission regarding Home Occupation, notices, and Hearings Official. Council discussed possible dates for a mid-year budget review meeting. It was agreed that the meeting would be scheduled for December 16, 1997 at 6:00 p.m. By consensus, council gave approval for staff move forward with the recommendations made with the exception ofthe MDS. 2. City Manager Mike Kelly provided a brief overview and summary regarding Ballot Measure 47/50 impacts.
