MINUTES OF THE WORK SESSION MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, OCTOBER 7,1996 The City of Springfield Council met in Work Session in the Jesse Maine Room, 225 Fifth Street, Springfield, Oregon, on Monday, October 7; 1996, at 6:10 p.m~ with Mayor Morrisette presiding. ATTENDANCE Present were Mayor Morrisette and Councilors Ballew, Beyer, Dahlquist, Maine and Shaver. Council~r Burge was absent (excused). Also present were Acting City Manager Gino Grimaldi, City Attorney Tim Harold, City Recorder Eileen Stein, Administrative Aide Shari Higgins, Development Service Director ~usan Daluddung, Senior Management Analyst Cynthia Pappas, Environment Service Manager Susan Smith and Police Chief Bill DeForrest. I. Museum Committee Appointments · Senior Management Analyst Cynthia Pappas presented the staff report. She stated the City has received five applications for the current vacancies on the Museum Committee. Ms. Pappas introduced the applica~ts present, incl,uding, Craig 'Spillman applying for the exhibit coordinator position, Bart McKee applying for the treasurer position and Helen Wagner and Kristie Redmond who are co-applicants for the education coordinator position. The other applicant, Vangy Smith applying for the membership/volunteer coordinator, could notbe present at the work. session. . Ms. Pappas stated all applicants meet the requirements of the Museum Committee and are . city residents. The applicants were also recommended for appointment by the Museum Board, of Directors. . By consensus, it was agreed that Craig Spillman, Bait McKee, Helen Wagner, Kristie Redmond and V angy Smith would be appointed to t~e Museum Committee at the regular session meeting. 2. Lane Regional Air Pollution Authority Mr. Grimaldi pr~sented an overview of the request from the Lan'e Regional Air Pollution Authority (LRAPA) Board of Directors asking the City Council to provide a formal' indication of support or lack thereof to the board by October 8, 1996. Mr. Grimaldi stated staff prepared three options for Council consideration: 1) Support LRAP A without additional comment;. 2) Support LRAP A with the provision that the Council's representative ask that the LRAPA Board form a technical task forceto do fact finding on DEQ/LRAP A differences with regard to policy, application of policy, fees and penalties, at;ld make recommend~tions to the LRAP A ~oard concerning differences that are not justified and why, and differences that are justified and why; and 3) Issue a statement 'of non-support and terminate participation in LRAP A. , I . . . . Councilor Maine, who is the city representative on the LRAP A Board, stated she favors option #2, as keeping things status quo would show that there is qot concern by the City and the rumors and issues will continue without re~olution. ' Councilor Maine stated her support for the fact finding team or task force to either reaffirm . the policies now in place, or change them because they need to be changed. Some rules may need to be different for the area and some things may need to be refined and updated. Councilor Maine explained that now is the time to provide education and give the Board of Directors some better information and knowledge to base their policy decisions on. Her point for the task force is not to be broad in focus, but provide definitive information. Councilor Ballew raised the issue of why Lane County needs a special regulatory agency , for ai... quality. Council discussed the many benefits provided by LRAP A and why in economiq development cases specifically, the city benefits from their services. \ Councilor Maine stated she is chairing a LRAPA transition committee. to assist in placing an interim director when Don Arkellleaves the agency in December. Councilor Maine provided infor:mation on issues which need to be addressed by the transition committee. ' Councilor Shaver supported option #2, and felt that LRAP A serves the Springfield/Eugene area better than the state and federal agencies do. With the review which would occur in , option #2, Councilor Shaver felt that future errors and issues surrounding LRAP A could , be avoided. ' Environment Services Manager Susan Smith offered to provide education to the Council as a whole or any Co~nciiors individually, who would' like to know of specific areas of assistance that LRAP A provides to the city. She stated her division)s qmvinced that they receive much better support from LRAP A than they could from the Department of Environmental Quality (DEQ). ' Councilor Beyer stated she supported option #2. Councilor Dahlquist asked how long the task force might take in their review. Couricilor , , / Maine discussed her desire to be completed by the beginning of 1997 and felt with the support of technical staff, other board members and obtaining the proper information, that the process should go smoothly. IT WAS MOVED BY COUNCILOR SHAVER, WITH A SECOND BY COUNCILOR DAHLQUIST, TO SUPPORT THE CONTINUATION OF THE LANE REGIONAL AIR , , POLLUTION AUTHORITY (LRAP A) WITH THE PROVISION THAT COUNCILOR MAINE ASK THE LRAPA BOARD TO FORM A TECHNICAL TASK FORCE TO DO FACT FINDING ON DEQ/LRAPA DIFFERENCES WITH REGARD TO POLICY, ADOPTION OF :pOLICY, FEES AND PENALTIES, AND MAKE RECOMMENDATIONS TO THE LRAPA BOARD CONCERNING DIFFERENCES THAT ARE NOT JUSTIFIED AND wHY, AND DlFFERENCES THAT ARE JUSTIFIED,AND wiN. THE MOTION PASSED WITH A VOTE OF 5 FOR AND 0 AGAINST (COUNCILOR BURGE WAS ABSENT). City of Springfield .' .. ."Work Session - 10/7/96 Page three . Councilor Shaver asked that fines for first time offenders be reviewed and possibly mitigated as people who are not likely to be repeat offenders should be given some special consideration. 3. Other Business ; Chief DeForrest spoke about the dance hall permit and liquor license endorsement request for EI Barrio being discussed in the regular session following this meeting. He explained his thr~e main concerns regarding Council approval of the liquor license: I) ~t would add one more liquor dispensing business in the downtown area, 2) it would allow both adult and minor entertainment at the same time in the same building and give minors visibility to alcohol, and 3) i'sEI Barrio a suitable environment for minors. Chief DeForrest explained his recommendatio'u would be to approve the dance hall ' permit, per Chapter 8 of the City Code, specifically: 1) all dances shall be open at alll times for inspection by any police officer of the city, county or state, 2) all dances shail be closed on or before the hour of 12:00 midnight, 3) all dance halls shall be brightly lighted during the progress of dances, and 4) all dances in darkened rooms are prohibited. . Chief DeForrest recommended Council denial of the OLCC liquor license application. If OLCC then grants the liquor license, he recommends Council prohibit minors from being on the premises and the licensee should be required to provide adequate security, to be determined by OLCC, to ensure orderis maintained inside I:lndoutsidethe premises. If . OLCC grantsthe liquor license and allows ,minors onthe premises, he recommends Council impose the following conditions: 1) the licensee ,shall provide adequate security, to be determined l;>y OLCC to ensure, order is maintained inside and outside the premises and to deny minors access to the liquor dispensing area, 2) the licensee shall provide an adequate barrier, to be determined by OLCC, to separate minors from the liquor dispensing area, and 3) the licensee,shall comply with all the pr,ovisions ofth~ Springfield City Code regulating the operation of a dance halt'. " . Building Official Dave Puent said that EI Banio has already'held one dance, without prior approval on October 4, but that no alcohol was served and the attendance'was small. Council discussed whether or not to recommend approval of the dance hall permit or liquor license. The discussion was continued at the regular meeting.
