After speaking with Jim Donovan, the Urban Planning Supervisor, and Dennis Ernst, the City Surveyor, we agree that it is appropriate to locate the existing sewer lines and place them in specific easements. This may require relocating the lines to create a buildable area on Parcel 2. This will prevent future construction on Parcel 2 from impacting the sewer service to the adjacent properties and it complies with the requirements of the SDC. This decision is based on assessment of the facts and application of the SDC. The property contains a 10" sewer line going EMJ. Within the site, there are four taps on that line. Two of those taps connect to adjacent parcels to the south. The existing easement is a blanket easement over the entire property. The exact location of the lines feeding the adjacent parcels has not been identified. To ensure continued sewer service to the adjacent parcels, the lines shall be located and an easement across ParceJ1 andlor Parcel 2 shall prevent any future construction from encroaching onto those line(s). If the line(s) need to be relocated to allow construction on Parcel 2, that cost shall be born by the applicant requesting the land division. In regard to.your statement that this action was not speCifically included in the conditions of approval, neither the Springfield Development Code nor the conditions of approval can conceive of every situation that will arise during a land division. For that reason, the SDC contains some general requirements that are applicable to every development. In this case, SDC 32.120(1)(b) is most relevant. It states: "The developer shall be responsible for the design, installation and cost of utility lines and facilities to the , satisfaction of the utility provider." The utility provider (the city) requires assurance that the proposed land division will nofinterrupt sewer service to the adjacent parcels. We have had an issue come up today in ref. to my plat getting approved by Dennis in the survey office at Springfield. My surveyor, Kent Baker is stating that Dennis does not like the easement that is in place for the exciting sewer line, it is a broad easement over the property. This was not a condition of my approval, and I should not have to burden the costs for additional survey of the specific line description. I believe that I have met the conditions required for my partition. When a home is build on the back lot the builder will engineer the sewer hook-up and the easement for the line. I don't feel this is a reasonable request at this stage of the game. I believe I have met the conditions of approval and would request that my partition be approved for recording. Thank You / .
