Dear Steve,
SybEagleWolfe and I (Wendy EagleWolfe) have studied the "Notice of Decision-
Subdivision/ Partition Tentative Plan" regarding the proposed Tabor,Griffin Cluster
Subdivision at 2095 5th Street case number: SUB 2008-00029. We continue to have
concerns which we do not feel have been adequately addressed in the plan. We have
obtained the "Appeals Application, Type III" and pending information received when we
meet 8/15/08 we are prepared to file the Appeals Application.
Our remaining concerns are as follows:
1 )We have requested sight obscuring privacy fencing and vegetative screening as'
specified in section 4.4-110 and 4.4-115. In discussion with Steve Hopkins Planner II there
was discussion regarding the possibility of an eight foot double sided privacy fence-
perhaps being parallel to our current chain link fence with vegetative screening. Steve
voiced a valid concern that if the fence were very dose to our current fence it may weaken
our fence. For this reason we ask that there be a sight obscuring double sided fence and
vegetative screening set back from our current fence and fence line vegetation an adequate
distance to prevent any loss of integrity to our current fence and fence line vegetation. This
would also allow proper maintenance of our fence and the new fence. We would also
request to be notified regarding who will be responsible for maintaining the new privacy
fence and vegetative screening for as long as this development is in existence.
If this is not possible we request a meeting with any individuals with decision making power
in thisflrocess so that a mutually agreeable decision can be reached regarding the matter of
privapy/enc!ng and vegelfltiye screening. '.' , , ",

3)We continue to have concern that 12' streetlights next to our bedrooms and private yard
areas will disturb our sleep and diminish our solitude and'privacy. Even shielded lights '

4) We remain concerned by risk of flooding to the residence and landscaping at 2103 North

6) In relation to maintenance of privacy and given that the bedrooms of our single story
residence are south facing we request that North facing windows be avoided on the seqond
floors of any dwellings adjoi~ing our property induding but not limited to lots 1, ?, 5~"7.
