Nature of Application: The applicant is proposing to add a U,Haul Truck Rental business to an existing
business of heavy truck and used auto sales along with Administrative offices for the Miller Group, The
applicant has already occupied the site and is conducting business at this location. Certain conditions of the
previous Minimum Development ~tandards review (DRC2007,0002 I) to ~t't" _ , . the truck and car sales,. .
have not yet been completed, The conditions of the previous decision are reiterated in this MDS, Some of

by fencing with approximately half the lot paved and contains two buildings for commercial use along with
a covered carport area The other half contains'a single family home and unpaved area separated by a chain
link fence at the rear of the house, Previously this single family home was used as a night watchman's
quarters (MDSI998,04-081) but has since been rented out as a home, The applicant has moved his truck
and car sales business and now U,Haul rental bUsiness on to the property and is utilizing the paved area as
truck sales, car sales and U,haul rental area and the unpaved area behind the house as stor:age for trailers

Standard: Springfield Development Code (SDC) 4.7-115 A.2. requires that all truck rental
facilities shall have approved concrete wheel stops and a four foot high fence where permitted
in this Code, preferably chain or cable, with boIlards placed at 5 foot intervals and secured in
the ground with concrete footings of appropriate size and depth to prevent trucks from
driving on sidewalks or over curbs,
Finding: The applicant has proposed using the existing railroad ties installed in the ground as a
border of the required planted setback to substitute for the required concrete wheel stops,
Finding: SDC 4,6-120 requires that concrete wheel stops be setback a minimum of 2 feet from the

31.190(1) requires that all parking areas shall have a durable, dust fee surfacing of asphaltic
concrete, Portland cement concrete or other materials in accordance with the Building Safety
Codes and approved by the Building officihI.
Finding: A portion of the lot is not paved. Site visits have shown trucks and truck trailers
parked on this portion of property.

property making this a 2-way driveway. .
Finding: The submitted plot plan shows three V-Haul Vehicles parked in the area of this
driveway reducing it to 15' wide.

5) Access onto the public right-of-way shall comply with SDC Section 4.2-120.
1. Where the property abuts an improved street, any non-conforming or unsafe curb
cuts, as 'determined by the Transportation Manager, shall be removed and replaced
with curb, gutter and sidewalk.
2. Where the property abuts an unimproved street, any non-conforming or unsafe access
points, as determined by the Transportation Manager, shall be:
a. Removed by the use of fencing, extruded curbs or other method of approved
barricade; and
b. The property owner shall sign an Improvement Agreement guaranteeing future
Participation in a Local Improvement District.

Condition 12: A site visit by the:City of Springfield Traffic Engineer indicated limited
visibility of traffic coming around the curve from Q Street and heading north on Laura
from the driveway on Laura Street due to the large semi-truck tractors parked facing the
fence along the entir,e south-west perimeter. Below are three options to choose from one
of which will be required to meet the criteria to allow safe access onto a public right-of-
way:

c) Brackets were approved as a method to remove gate access to Laura Street while
keeping the curb cut in place for possible future use which may not have large
trucks parked in this area. While this use remains these brackets must remain in
place and the driveway orto Laura Street shall not be used.
6) Concrete sidewalks shall be installed where the site abuts a curb and gutter street as
specified in SDC Section 4.2-135.

this area. While this use remains these brackets must remain in place and the driveway
onto Laura Street shall not be used.
In order to complete the review process, a Development Agreement is required within 45 days
from the date of this decision to ensure the terms and conditions of this application are binding
upon bo'th the applicant and the City. This agreement will be prepared by Staff and upon
approval of the Final Plot Plan, must be signed by the property owner prior to avoid revocation
of the DMV Location Approval and to avoid Code Enforcement Action.
THE APPLICANT MAY SUBMIT CONSTRUCTION OR BUILDING PLANS TO OTHER CITY
DEPARTMENTS FOR REVIEW PRIOR TO FINAL SITE PLAN APPROVAL IN ACCORDANCE
WITH SDC 31.080 AT THEIR OWN RISK. ALL CONCURRENT SUBMITTALS ARE SUBJECT TO
REVISION FOR COMPLIANCE WITH THE FINAL PLOT PLAN. A DEVELOPMENT AGREEMENT
IN ACCORDANCE WITH SDC 3 I .090 WILL NOT BE ISSUED UNTIL ALL PLANS SUBMITTED BY
THE APPLICANT HAVE BEEN REVISED. CONFLICTING PLANS CAUSE DELAYS.
The construction of the required improvements shall be completed within 90 days of the date of
this decision. If the established time line cannot be met, the applicant may submit a written
request for a time line extension as specified in SDC Section 31.010(5) (b).
If the established time line is not met and the applicant has not requested an extension, the
Director shall declare the application null and void if the property is occupied and the r'~r~:f
owner shall_ be considered in violation of this Code. If the established time line is not met and the
applicant has requested an extension and that time line has not been met, the Director may
require-the improvements be installed as specified in SDC Section 31.110(4).
PERMITS THAT MAY BE REQUIRED:

All new sewer taps will require permits from the Public Works Department prior to
connection.
Sidewalks and driveway curb cuts and closures require permits from the Public Works
Department.
Building permits will be required for the construction of the building and the paving of
the parking lot. ,
An LDAP permit will be required for,a11 grading, filling and excavating being done.
Sign Permit-NOTE: Signs are r~gu1ated by the Springfield Municipal Code Article 9,
Chapter7. The number and placement of signs must be coordinated with the Community
Services Division. The location of signs on a Site Plan does not constitute approval from
the Community Services Division.

Appeals: This Type I decision is exempt from the provisions of ORS 197.195, 197.763 and 227.173
and therefore cannot be subject to the appeal provisions of SDC Article 15, Appeals.
