Reauest TIlls request is for tentative approval of a land division or partition to divide a single parcel into two separate parcels. II. Backe:round The applicant attended a Developmental Issues Meeting with City staff on November 10, 2005 (Zone2005-00054) to discuss the proposed partition and rezone of the property. At that time staff stated that it appeared that the property could be partitioned once it was rezoned from Low Density Residential to Medium Density Residential provided that the proposed tax lots could meet the setback requirements. III. Site Information The subject property is located on the south side ofWest:"M" Street at the corner of Rainbow Drive' and is developed with a single family dwelling and a duplex. The site address of the singl.e family dwelling is 859 West "M" Street. The site address of the duplex is 1395/1391 Rainbow Drive. The property is identified as tax lot 300 l' of Lane County Assessor's Map 17-03-27-43. A copy of the Assessor's Map is attached as Exhibit A which is located after the narrative. An aerial map is also attached as Exhibit B. The property is currently zoned Low Density Residential. The properties to the north, south and east are zoned Low Density Residential and are developed with single family homes. Property to the west (Tax Lot 1700 of Assessor's Map 17-03-27- 34) is zoned Medium DensityResidential. A map showing the zoning of the surrounding properties is. attached as Exhibit C. ' The property is designa1ed Medium Density Residential on the Eugene/Springfield Metro Plan Diagram. Because of the apparent zone/plan conflict, the applicant requested a city sponsored zone change to rezone the property from Low Density Residential to Medium Density Residential (Zone2008c00013). The public hearihg on this city sponsored zone change is scheduled for May 20, 2008. A map showing the zone/plan conflict is attached as Exhibit D. Land Division - Tentative Partition Criteria The following narrative outlines how the proposed land partition complies with all the Tentative Plan Criteria set forth in SDC 5.12-125 (A through I) which are applicable to the subject property. "A The request conforms to the provisions of this Code pertaining to lot/parcel size and dimensions" ResDonse: The subject property is 11,761 square feet in size. The proposed partition to divide the property into two lots would meet the density standards for parcels in the Medium Density Residential zone. The single family dwelling would be located on Parcel 1 and would be approximately 4,642 square feet in size. , The duplex would be located on Parcel 2 and is proposed to be approXimately 6,445 square feet in size. A photo showing the single family dwelling and the duplex is attached as Exhibit E. Both parcels meet the setback and street frontage requirements set forth in the Springfield Development Code. Parcellhas a front yard setback of approximately 19 feet and a 10 foot rear yard setback. The interior side yard setback is approximately 24 feet and the side yard that abuts the street has approximately 19 foot setback. There is approximately 75 feet of street frontage along West M Street. The existing single family dwelling located on Parcel 1 takes access off West M Street. Parcel 2 that is developed with the duplex has a front yard setback of approximately 29 feet and a rear yard setback that is approximately 12 feet. The side yard setback that abuts tax lot 3300 is approximately 14 feet. The side yard setback that abuts the rear yard of Parcel 1 is 6.1 feet. There was a roof overhang that connected the duplex and the single family dwelling which has since been removed. Exhibit F shows that the roof overhang connecting the two dwellings has been removed. Parcel 2 has approximately 80 feet of street frontage along Rainbow Drive. "B- The zoning is consistent with the Metro Plan diagram and/ or applicable Refinement Plan diagram, Plan District map, and Conceptual Development Plan. ResDonse: The subject property is currently zoned Low Density ReSidential and is \ designated Medium Density Residential on the Metro Plan Diagram. jRH LAND USE DIVISION I Tentative Land Partition I Burr I May 12, 2008 " PRE-SUBMITTAL REC'O MAY 1 3 2008 + The applicant is requesting that the subject property be rezoned to Medium Density Residential to correct the zone/plan inconsistency. There are no Refinement Plans or Conceptual Development Plans that applicable to the subject property. "c. Capacity requirements of public and private facilities, including but not limited to, water and electricity; sanitary sewer and stormwater management facilities; and streets and traff/(; safety controls shall not be exceeded,and the public improvements shall be available to serve the site at the time of development, unless othenvise providedfor by this Code and other applicable regulations. The Public Works Director or a utility provider shall determine capacity issues." ResDonse: There is sufficient capacity to serve the proposed partition. The site is currently being serviced by electrtcity, water sanitary sewers and stormwater management facilities. A copy of the City's Storm and Sanitary Sewer Mapsheet C07 showing the location of these services is attached as Exhibit G. According to Public Works the proposed partition does not require a Stormwater Management System Study. A copy of the email from Public Works is attached as Exhibit H. "D. The proposed land divisioh. shall comply with all applicable public , and private design and construction standards contained 'in this Code and other applicable regulations. " ResDonse: The proposed land division to divide a single parcel into two separate parcels will comply with all applicable public and private design and construction standards. "E. Physicalfeatures, including, but not limited to: steep slopes with , unstable soil or geologic conditions; areas with susceptibility of flooding; signif/(;ant clusters of trees and shrubs; watercourses shown on the WQLW Map and their associated riparian areas; wetlands; rock outcroppings; open spaces; and areas of historic and/or archaeological signif/(;ance, as may be specified in Section 3.3-900 or ORS 97.740-760, 358:905-9555 and 390.235-240, shall be protected as specified in this Code or in State or Federal law. The subject site located outside the 500 year flood plain based on FIRM Map 41039C1141F. The subject property is not in an area of hist~ric or archaeological significance. "F. Parking areas and ingress-egress points have been designed to: JacUitate vehicular traffIC, bicycle and pedestrian saJety to avoid congestion; provide connectivity within the development area and to adjacent residential areas, transit stops, neighborhood activity centers, and commercial, industrial and public areas; minimize driveways on arterial and collector streets as specified in this Code or other applicable regulations and comply with.ODOTaccess mnnagement standardsJor State Highways. ~ Resoonse: There is driveway access along West "M" Street that provides access to the single family dwelling on Parcell. . There is driveway access along Rainbow Drive that provides access to the duplex on Parcel 2. Both driveways meet the standards set forth in Table 4.2-4 for'driveways on local roads. West "M" Street is fully improved with curb, gutters and sidewalks. -Rainbow Drive has not been improved to City standards; therefore, the applicant is proposing to dedicate 5' of street frontage - along Rainbow Drive for future public improvements. TIlis 5' right of way dedication is indicated op the proposed partition. "G. Development oj any remainder oj the property under the same ownership can be accomplished as specified in this Code., Resoonse: The entire site is under the same ownership has been fully developed. The property owner intends to sell the single family dwelling that is located on Parcell. There is an existing older duplex on Parcel 2 which could be redeveloped at some point in the future and still comply with this Code. . "H. Adjacent land can be developed or is provided access 'that will allow its development as specified in this Code. .. Resoonse: All adjacent properties are currently developed and can not be further developed; therefore, this criterion is not applicable. " ' , ResDonse: The subject property is entirely within the city limits, therefore; this criterion does not apply. V. Summary The proposed partition separates the two eXisting dwelling onto their own tax lot and would allow the owner to sell the dwellings separately. The city is currently looking into land efficiency measures that would provide opportunities for infill and redevelopment and allow for smaller lot sizes. These measure help. to more effiCiently use the land that is currently in the city limits wliiIe still providing for growth opportunities. This proposed partition is an, example of how these land efficiency measures can be used and the proposed partition does not change the nature of the eXisting neighborhood and does not create the need for additional services. The applicant recognizes that at some point ' Rainbow Drive will be improved to city stahdards and has provided additional rightcof-way to allow for the future improvement. Based on the information provided in this narrative the city may approve the proposed partition as submitted.
