I hope the meeting today helped - I'm sorry about the confusion regarding the Gibson/ODOT ownership issue-
our City Surveyor musfnot have done the full research .before telling me it looked like Gibson owned the whole
tax lot from the wording in the title report. ' .
I spoke with my supervisor and a few other planners regarding your questions at the meeting, and I have some
answers for you. Basically, we cannot accept your complete submittal until the ownership issue is resolved since
applications cannot be submitted for development without all owners' permission. So, three options exist...
1. You are successful with the quit claim and submit the site plan application for the entire development
area. .
2. ODOT is not willing to relinquish ownership but is willing to provide written permission for Gibson to
develop their portion of the development area, and you include such written permission with your site
plan application for the entire development area (ODOT also signs the:application in this situation),
3. ODOT is willing to neither 'relinquish ownership nor provide permission to develop their portion of the
development area, and you submit a site plan application for a development area that only includes
the property owned by Gibson. ' .
As toa narrative, none of the planners around here have reviewed a site plan in neighborhood commercial since
we have so little of it, so no one was able to give me a sample of a n,arrative that discusses how an NC.
development enhances th~ surrounding residential neighborhood. However, the narratives we usually see are
generally brief - no more than a page or two - and would discuss the topics I outlined in the pre-submittal
checklist, as copied below. I understand your concern that what is built needs to substantially conform to what is
approved, but unfortunately, it.is important for the owner/applicant to make some decisions about appearance
now because we need to make sure the new development does not intrude upon the character of the .
neighborhood - so, the narrative, combined with some coloring and'material info on the elevations, should do that
for us. ' . ., ,
. Please provide a brief narrative as required per 5.4-105 B.1., 5.177120 A.6, and 5.17-
. -. .. . . .
120 1.1. The narrative should 'explain the existing use of the property and the purpose
of the proposed development. It should mention who might use the parking space
proposed in the rear of the building. It should also provide more information on the
number of proposed retail tenants, the type p,otential retail tenants, and the proposed
number of employees and future expansion plans, if known. In addition, it should
describe the exterior of the building in more detail, including the colors to be used, how
the fa!;ade of the existing structure will be changed, and how t!1is NC development
enhances rather than intrudes on the character of the neighborhood by using
landscaping, building materials, and design features that are similar to and ih
proportion with residential uses as per 3.2-305 A.
As I said at the meeting today, we can deal with the PUE doclJmentation as part of the site plan reviewprocess.

Hi Matt,
I just spoke with the City Surveyor this morning - he said that everything looks good with respect to the ownership
issues: It looks like Gibson owns all of tax lot 5317 as shown on the Assessment and Taxation Maps. However,
Gibson does not awn tax lot 2101. Therefore, the plan set should be revised to show the lot boundary as being
. the boundary of tax lot 5317, and all coverage calculations should be adjusted accordingly.

As to the easement issue, my supervisor, Jim Donovan, and the City Surveyor are in agreement that there is no
need to vacate the existing blanket easement over the'vacated right-of-way area. Instead, the applicant will need
ta dedicate new public utility easements for the public utility lines that run through the property (a process that will,
in effect, wipe out the existing easement rights over the vacated right-of-way). To make that process as smooth
as possible, I suggest getting something in writing from each utility provider (SUB Water, Northwest Natural for
both gas lines, and City for stormwater) stating the minimum easement width they will approve. .

No problem. I'll get back to you as soon as I speak with my supervisor and we figure out who should be present
at the meeting. Since you bring up Condition #4, I should let you know that the final plot plan that was approved
for the coffee kiosk showed the kiosk being located 10',9" frorTI the stormwater line, but the survey of existing
conditions for the current site plan review indicates that the kiosk is actually located only about 5' from the line.
Either way, I'm sure we'll be able to work out the easement issues somehow. Have a'good long weekend!

Hi Molly,
I reviewed through the conditions below with our planner and several additional question have arisen. This has
turned into a complex little site, and we'want to work with the city to meet the existing conditions and intent. We
would like to request that someone be present at.our meeting with historical knowledge of the issues, and who
would be able to assist in making decisions. One item related the the easement interpretation that seems to allow
building within the easement established by condition 4. We would also like to review any additional documents
that links condition 5 and 7 per our recent conversation. I will be out of the office Friday and Monday, hopefully a
Tuesday meeting will work. . .

Hi Matt,
Thanks for the Title Report. I forwarded it to our City Surveyor to look over, and I'm just waiting for him to get
back to me. As soon as I hear back from him, I'll let you know when we can meet to talk about the vacation
process.
In the meantime, below are the conditions of approval for the coffee kiosk, taken from the letter of decision dated
2/19/04. Conditions # 5 and # 7 are the important ones to be aware of.
Condition 1. As specified in SDC 18.050, front and street sid\< yard setbacks ~hall be seven feet in the
Neighborhhood Commercial district.
Condition 2. The Final Plot Plan shall show the required seven-foot landscaped planter strip as
specified in SDC Section 31.130, 31.140 and 32.050. The plan shall show size, species and spacing
for the required landscaping.
Condition 3. Provide a legend on the Final Plot Plan ipdicating the various utility lines within the
PUE. . ,
Condition 4. The Final Plot Plan shall show setbacks from the coffee kiosk to the affected utility
lines within the PUB. .
Condition 5. No structure shall be located closer thari ) 0 feet to the' public storm sewer:
Condition 6. The applicant shall obtain an approval letter or sign off from the affected utility
companies (SUB and Northwest Natural Gas).
Condition 7. Upon receipt of written notice from the City, the applicant shall remove the coffee
kiosk and all associated appurtenances from the existing easement and restore the surface of the
easement if so directed. In the event the applicant fails to remove the coffee kiosk and
appurtenances within the time allotted in the written notice, the City l)hall have the right, but not the
obligation, to remove these encroachcments and to bill the applicant for its full cost for the removal.

Condition 8. The' applicant shall obtain all required encro~chment, electrical, plumbing, sign and
building permits through the Engineering Division and Community Services Division of the City for

Attached is the Public Works Transportation Pre-Submittal Checklist for PRE2007 -00071 (Site Plan Review for
Gibson at 69th and Main), so you now have a complete checklist from today's pre-submittal meeting from all
departments. Please see Greg Kwock's notes below, as well. .
I also wanted to let you know that I looked at the documents approving the coffee kiosk, and as long as the
conditions of that approval continue to be met, we will allow the kiosk to remain where it is, as long as the
ownership issues regarding the development area are resolved.
I did want to let you know, however, that in looking at the coffee kiosk file I noticed that, at least at that time, there
was an underground Owest utility line in' the easement area that is not depicted on. your plans for this site plan
review - the location of that Owest line should be depicted on the existing conditions / utility plan if indeed it still
exists. .
Let me know when you get the title report, and we can proceed towards resolving the ownership issues. In the
