I Applicant Response: See plat, right-of-way is dedicated on the face of the plat. Staff Finding: The right-of-way dedication is shown on the face of the plat. However, Survey must confirm that this is sufficient documentation for ~ right-of-way dedication. . . Condition #2: Prior to plat approval, the applicant sAall execute and record an Improvement Agreement for paving, curb, gutter, sidewalk, street t)-ees, and street lighting. Applicant Response: Please see attach~d improvem~nt agreement. . Staff Finding: A draft Improvement Agreement is indluded with the pre-submittal packet, However, storm water and' sewer must be added to the agreement per PW Engineering even though this was not requested at the time of Tentative approval since it is conceivable that sewer and storm lines will be included with any futurel street upgrades. In addition, the agreement must be recorded prior to plat approval. Condition #3: Excavation or filling in the vicinity of the existing street trees, as well as any future removal of these trees, must conform to the st1ndards of the SDC and EDSPM. Since ' these street trees are located on private property, ma'intenance of the trees shall be performed by the property owner as per SDC 4.2-140 C.2. I Applicant Response: Applicant is aware of this requirement. Staff Finding: No further action is required at this ti~e. ' I. I Condition #4: Prior to plat approval, the location of the private sanitary .sewer lateral( s) 'serving Parcels 1 and 2 shall be located. , - I ' . , ' Applicant Response: This is a non issue because the applicant has constructed two separate sanitary sewer services with both services being on t~eir respective parcels and no easement is needed. Staff Finding: Building has confirmed that two separ~te sewer laterals have bee'n installed' within the boundaries of each respective parcel. , Condition #5: Prior to plat approval, Parcel 2 shall be serviced with a private sanitary sewer lateral from the eight-inch sanitary sewer main in the!right-of-way to the northwest of the property if a lateral to Parcel 2 does not already exist. NOTE: Plumbing permits are required to install this private sanitary sewer lateral. ' Applicant Response: See comment on Condition 4 Cjbove. I Staff Finding: Building has confirmed that sanitary sewer service has been provided to Parcel 2. . ' Condition #6: Prior to plat approval, the applicant shall record and document a private utility easement adjacent to the sewer lateral on Parcel 2 to benefit Parcell. 6{10{2008 20f7 ApplicantResponse: AppliCant has reconstructed sanitary sewer service to both 'parcels, with both being on its respective parcel (see Condition 4 above). Staff Finding: Building has confirmed that sanitary sewer service has been provided to each parcel within the boundaries of each respective parcel. . Condition #7: Prior to plat approval, the applicant shall extend electric service from Pole # 58164 in the northwest comer of the property as per SUB Electric standards. Placement of such facilities shall be in the proposed seven-foot frontage PUE and shall be underground as , conditioned in the Underground Placement of Utilities section below. Applicant Response: Applicant has installed underground electric in accordance with SUB electric standards. Staff Finding: SUB Electric has stated that electric service has been extende~ to each parcel underground as per SUB electric standards, Condition #8: Prior to plat approval, the applicant shall record and document a seven-foot private utility easement in between the parcels extending east approximately 45 feet from the west property line. Applicant Response: Requirements for this condition have been aitered as the applicant has placed all utilities underground on their respective parcels, except for a short utility easement for the underground gas line between the two parcels (see attached easement description). Staff Finding: SUB Electric has confirmed ttlat electric utilities have been installed within the boundaries of each respective parcel. SUB Water has confirmed that water utilities have been installed within the boundaries of each respective parcel. . , A description of the aforementioned private utility easement was included with this submittal. However, Survey must confirm that this is sufficient documentation for a private utility easement. In addition, please discuss why the private utility easement for the gas line does not extend to the west parcel boundary of Parcell as shown on the TentatiVE; plan. Condition #9: Prior to plat approval, all utility lines to serve Parcels 1 and 2 shall be placed underground. Applicant Respo~se: All utilities have been placed underground. Staff Finding: SUB Electric has confirmed that electric utilities to serve both parcels have been installed under9round. ,A City staff site visit on June 10, 2008 confirmed that all utilities are underground. Condition #10: Prior to plat approval, Parcel 2 shall be serviced with a private water lateral from the water main in the right-of-way west of the subject property and a water meter located as per SUB Water standards; In addition, Parcel 2 shall be disconnected from the existing, well, . and the disconnection shall be inspected and verified in compliance with SUB Water standards. NOTE: Plumbing permits are required to install this private water lateral. Applicant Response: The existing water line to Parcel 2 has been disconnected, and a new ,service has been provided to Parcel 2 from the water main on the east side of South 43rd, all in accordance with SUB water standards. Staff Finding: SUB Water stated 'that the water service and meter for 871 S. 43rd Street have been installed in accordance with SUB Water standards. They could not' confirm any information on the disconnection of the water line from the well to Parcel 2. Building concurred with SUB. 6/10/2008 , 3 of 7 Condition #11: Prior to plat approval, the applicant shall record and document a seven-foot wide PUE along the frontage of Parcels 1 and 2. Applicant Response: See plat, the seven-foot wide PUE is dedicated on the face of the plat. Staff Finding: The PUE is shown on the face of the plat. Survey shall confirm if this is sufficient documentation for a PUE. Condition #12: Prior to plat approval, all setback areas on Parcels 1 and 2 shall be landscaped in accordance with SDC 4.4-105. Applicant Response: Planner (Molly Markarian) met"with applicant on site the morning of February 8, 2008 to discuss this issue and hear the concerns the applicant had. After further discussion with applicant and other City staff members, this condition has been relieved. Staff Finding: City staff met with applicant at City Hall on 2/8/08 and determined that COA #12 does not need to be met until Parcel 2 is developed in the future. Condition #13: Future, development of Parcel 2 will require off-street parking in conformance with SDC 4.6-125. ' ' I ' , Applicant Response: Applicant is aware of this condition. Staff Finding: A parcel tag has been attached to this1parcei to e,nsure COA #13 ,is met. Condition #14: Future development of Parcel 2 will1equire paved panhandle driveways. Applicant Response: Applicant is aware of this condition. Staff Finding: A parcel tag has been attached to thislparcel to ensure COA #14 is met. Since the location of utility lines has changed significantly since the Tentative decision was issued, please submit an updated utility sheet prior to plat approval for, inclusion in the City's files documenting the location of all utility lines serving each parcel. . 2. Public Works' has raised concerns regarding drainage of Parcell onto Parcel 2. Applicant Submits a Land Division Plat Application for Pre-Submittal . The application must conform to the Land Division Plat Pre-Submittal Requirements Checklist on pages 5 & 6 of this application packet. . \ , . A pre-submittal meeting to discuss completeness is mandatory. ' I . Pre-submittal meetings are conducted every Tuesday and Friday, from 10:00am - noon. . " I ' , . The applicant will then have 180 days to make the application complete for submittal and acceptance by the City. 3. Applicant Submits a Complete Land Division ,Iat Application . When the applicant has addressed all items on the Pre-Submittal Checklist and the , City Surveyin9 Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Q'uad of City Hall. . The application must conform to the Land Division Plat Submittal Requirements Checklist on page 6 of this application packet. . If the submittal is deemed complete, the City Survey Section will sign-off on the City Survey approval sheet and send the applicant to the Development Services Department for application submittal and fee collection. . Planning staff checks and signs the mylars. : 4. Applic~nt Records Plat at Lane County & SUb~its Plat and Documents to City . ' . After Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor at Lane County. . After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development Services Department prior to the issuance of building permits. LAND DIVISION PLAT APPLICATION PROCESS Applicant submits land division plat application for pre-submittal , (See Land Division'ptat Pre-Submittat Requirements Checklist) 1 City departments review application for completeness and hold pre-submittal meeting to discuss completeness issues with applicant and applicant's representatives. ~~ Applicant addr~sses incomplete items. I City Surveyor checks application and returns comments to applicant's surveyor. Applicant's surveyor corrects plat and returns to City Surveyor. J City Surveyor conducts field check and returns comments to applicant's surveyor ~ / Applicant's surveyor sets new monuments and flags existing ones. 1 Once no errors appear on the plat and a current, title report is submitted, applicant's surveyor is given ok to submit complete land division plat application. 1 After ok giyen from City Surveyor and applicant has addressed all incomplete items from __ pre-submittal, applicant'submits complete application to the City Survey Section (See Land Division ptat Submittal Requirements Checklist) 1 City Survey Section signs-off on City Survey approval sheet and sends the applicant to the Development Services Department for application submittal and fee collection. 1 Planning staff checks and signs mylars and notifies applicant's surveyor of approval. 1 Applicant takes plat and accompanying documents to Lane County for recording. 1 ,I Applicant brings copies of recorded plat and documents to Development Services Department.
