Thank you all for addressing my issue on this partition. I would like to look at the package that their engineer
submitted and have some time to make a site visit. The drawing that Molly showed me this morning isn't
representative of what I remember when the drainage project was designed and installed. This site may have
been filled; regarded or perhaps the road ditches reconfigured.
I'm not aware of the 12' X 25' area that you reference. I would also agree that blanket easements are not
acceptable because they don't withstand the court tests.

George,
I just met with Matt and Molly. Could you please assist me in putting together something in writing with your
knowledge of the problems they are having on the site. Since you have the history of the problems with this site,
we thought you would be best for writing this up. We are going to have their engineer address it now as part of
their final plat review which is not usually the time but we do want it right. This is a very flat site and It sounds like
there may be a bigger issues that may be going on (beyond the very small area depicted by the spot elevations
on their plan, the 12' x 45' area) due to the amount of flooding we are hearing, including the under-floor areas
being flooded out. By the information we have available to us, we are not seeing what can be causing this
flooding problem. If we can specifically relay what we know has happened in the past, we can pass this on to her
engineer and he can provide us with a solution to this problem. A blanket drainage easement does not appear
to be an option. I really appreciate your assistance with this. .

Thanks for the follow-up. There's a very contentious history with this property. There have been drainage
problems which contributed to a septic failure. This lead to constructing less than standard wastewater service to
the ,property. . I . . . . : . .
Our maintenance division has struggled when similar situations1were constructed in the past. When the parcels
are sold and owners change, the "daisy chained" private conneytions sometimes fail. Each owner points fingers
and our maintenance crews have had to construct the fix, some~imes on private property. If indeed both parcels
have independent services from the public system, we're OK. If not, we are at risk.
The drainage issue was partially solved again by the City constlucting a back lot, non- standard drain to the
north. This was done because the road side ditch in front (street side) of the lot is not deep enough to drain the
rear of the lot or the crawl space under the houses. The propo~ed lot configuration will cut off access to the
drainage for the southerly lot. Again this partition may put the City at risk if the lot owners fail to cooperate or
establish documented easements and agreements.

Eric,
As to the sewer issue, the building department confirmed that separate sewer laterals were constructed to each
parcel within the boundaries of each respective parcel. Since ~W does not track encroachment permits in
Tidemark, there is no way far me to know if the person installing the sewer laterals obtained an encroachment
permit. On a related note, since the actual location of several of the utilities changed after tentative approval was
issued, I arn requesting a new utility plan besubrnitted prior 10 pial so that the City at least has a record of the
actual location of the utilities serving these parcels. I .
As to any flooding issues, I'm not sure in what form we would disclose such information to future property
owners. However, if you feel that the applicant has not manag€!d the stormwater runoff from both parcels
adequately as proposed on the tentative plan, please let me know so that we can ensure it happens prior to plat

indicated they their is now individual sanitary sewer laterals serving each parcel? Do you know how they
obtained approval (PIP or encroachment permit) for this work? They were going to provide an easement(s) and
"Y" off the existing lateral. Also, I learned in our Pre-DRC meeting (George Walker) that he is aware of history of
the under-floors flooding at this property. This is the first time"1 heard of this. I wanted to let you know because I,
as well as the City Engineer, believe this should at least be a disclosure for the future property owner(s). The City
Engineer, and I: do not believe this fact should prevent partition from moving forward but at least disclosure.
